One question that have never been tested in court as far as i know, is that some users use copyrighted material as their user pictures. So some users might have copyrighted material as their user pictures, and basically Amigaworld isnt allowed to republish them, even they are user pictures, yet they do. But i doubt there could happen much even if someone would take amigaworld.net to court because of that.
I believe it would be quite strong defence already to point out all the other websites with same problem. Perhaps someone should gather bunch of smurf user pictuers and send them to peyo and see if something happens, especially since im pretty sure someone )and probably more than just one) in some forum will be using username smurf with a smurf picture. |

I don't know the details of the sites licensing, so they may or may not be legal, but the frequent disseminated idea that it's okay to distribute copyright material free of charge just because it's old is obscene. Usage of small clips of art for icons etc would probabvly fall under 'fair use' so long as you were not misrepresenting yourself as a repersentative of the organsition owning them or defaming them. Posting of more substantial content gets more dubious, which is why sites like wikipedia go to some lengths to establish and display copyright inof on images shared there.

| Heh..... they even have a donate button. Little bit audacious in my opinion. Hosting illegal software and then wanting money for doing so.
Piracy is one thing, but profiting from other peoples hard work, even if it is old, is the act of scum as far as Im concerned. |

I guess everything else is about okay (depending upon country of course), except that you are offering those games for download. As far as I know, there is no country that legally recognises so called Abandonware. There however are countries which dont recognise copyright.
To have those games downloadable from your site, you need to ask permission for them from the copyright holders, like back2roots have done.
This is sometimes problematic as there might be only very little clue to who owns the copyright currently, as original copyright holders might have ceased to exist (bankrupt company) or people have died and those who inherited the game, dont even know they did.
I dont know if any country has this system as legal, but Teosto / NCB has this in my opinion good thing in its contracts, that if I want to use a song that someone have made long ago, by default i need his permission to include in my record. However, if it happens to be that original copyright owner is one way or other lost (once again, bankrupt company, artist died...), then there is this vague clause that if i saw enough trouble in trying to get his concent for using his song in my recording, but i simply couldnt find him, then it is looked as if he had given me the permission to use his song.
I wonder if some country have established something like this into their legal system. It would be good system for games for example. |

In which case, there is of course no legal issue, as there would be no entity with standing to file any court action.
However, having looked at the site and tried downloading a game, it is definitely illegal as they don't have any Amiga games, they are actually serving malware instead of what they are claiming. Clicked the download link and it wanted to send me a 4Mb .exe file, presumably Windows malware. So to hell with donating anything to them or using that site at all.
