| OK, well, let's give them the benefit of the doubt (again...). Hopefully they'll finally start to learn that doing something more constructive with the AOS 3.x heritage is best for all. Not necessarily open source it, but it least don't sit on it anymore.
I can't honestly see why a company like Hyperion who has been virtually bankrupt for years already, if it wasn't for A-EONs investments, has supposedly so much at stake.
I think selling of rights now is most likely the best thing they can do money wise. If they continue to frustrate and try to sell AOS4 to a ever declining audience all Amiga heritage ends up being worth sh*t.

For those that don't read German, Olaf is basically saying that these were betafiles which were not be intended to be used for more than 3 months and displayed warning signs if you used them longer.
Some "smartasses" removed the warning signs and circulated these files on the internet.
He also recommends NOT to use these files.
Just in case Google translate fails ...

This came as much as a surprise to me as it came as a surprise to me that Norway also has right wing mass murderers and the police is as incompetent in Norway as it is in Belgium.

Yes ;)
To be honest, I am very fond of Belgium, I make sure to go at least once every year, typically around FOSDEM in February, and/or during summer/fall. :)_________________ B5D6A1D019D5D45BCC56F4782AC220D8B3E2A6CC |

Well, in that case, let me know when you visit again and we can have a chat in person over a good Belgian beer. We frequent the same circles I believe. _________________ This post reflects the personal opinion of Ben Hermans and not necessarily of Hyperion Entertainment CVBA. |

I enjoy living here, but just like any country it has it's faults and perks. I'm considering heading to FOSDEM next year. |

Just me...but if the business site and the faillissementsdossier.be site come up in google when one searches this topic, I would think they could be updated with the correct/current information if notified. Is this not possible?

Hyperion is not the only one to blame in this case. Hyperion was rather complacent in the field of trademarks until Cloanto registered "Amiga" trademark threatening Hyperion´s core market. |
In 07-Feb-2017, Hyperion registered "Amiga Forever" trademark in Benelux. This was the first stone thrown. The Amiga Forever trademark is utterly worthless to Hyperion. They knew perfectly well who owned it. The only reason for Hyperion to register that trademark (though probably having very limited effects) was to f!ck Cloanto. Later they also filed for "Workbench" (and they also put to market a product using that mark) for the same reason. The second stone (more followed). Amiga Forever and Workbench are registered marks in the US (the heavy-weight jurisdiction that counts) owned by Cloanto, marks that has been used by Cloanto for twenty years. Everyone knows that. So please don't try to put Hyperion in high moral grounds here. It's obvious to everyone what they have been doing.
Cloanto aren't throwing stones at all. They own the Amiga copyrights (at least up to the Commodore "Checkmark Branch" 3.1, but most cerainly all the way up to their 3.9 remake "Workbench 3.X" as well). So they are the legal (and moral) owner of the OS. When they filed the registration for the Amiga trademark in January, it was abandoned. It was unregistered. Belonging to no-one. As the legal owner of Amiga, it could very easily be argued that registering the available Amiga trademark was entirely within their legal and moral right to do. Not an attack on anything or anyone.
Hyperion doesn't own anything. They had a license with an unrelated third party for use/development. Now they are just f!cking people and the Amiga, attacking wherever they can reach, whenever they can. |

You know, you can make your point using less colorful and accusatory language. It's understandable if you react like this once, but every time Hyperion comes up it's like you have a personal score to settle with them. |

"An Exclusive Licence means that no person or company other than the named licensee can exploit the relevant intellectual property rights. Importantly, the licensor is also excluded from exploiting the intellectual property rights. If the licensor wishes to continue to conduct any activity covered by the intellectual property (for example, a university licensor may wish to continue its research), or if the licensor has previously granted any rights in relation to the intellectual property, the exclusive licence will need to expressly state that it is exclusive subject to those carve-outs."
Read that second sentence again until you understand it.

Well, your gentle/kind clarification ... that didn't last long
Stop acting like we're a bunch of retards. It's really not that hard to understand what is said.
Or shall I remind you of your flawed (read: incompetent) interpretation of the Settlement Agreement not so long ago ?

You wouldn't happen to have a copy of this that is signed and dated by the judge and recorded by the court would you? Because the document you linked is essentially a worthless document until it is signed by the judge and recorded by the court. This document is missing everything that makes it legally binding in the US. |
