Whereas I normally take GenerationAmiga with a ton of salt I guess this news item may be the nail on the head.

My presonal interpretation:

There is not so much an individual issue between Hyperion and A-EON/AmigaKit, but since it is clear that the validity of the original settlement is becoming more and more unclear and hence all licenses that are a consequence of that.

Now, me personally I hope this will lead to all rights ending up at Cloanto, meaning that they will be the ones to discuss the Amiga (One) name with for A-EON. When Mike delivers on his promises (which he has a challenge with, where is that loooong overdue announced official statement and the amiga.com new website), this may be a lot easier and maybe even becoming plain and simple Amiga instead of AmogaOne for A-EON...?

Yes, people like names. A new name, unencumbered by copyright claims, is not a bad idea. A good start would be the word "friend' in a language other than Spanish. "Amica" is probably too close, but there's got to be something between that and "Phooj Ywg" that would work.

I'd say GF would be fitting.

The new hardware will not be the X4000, X6000 or X8000 but simply the XXX.

Once released, I suppose most will like to play with their XXXy GF..

I apologize. I should have said, "it is rumored that Hyperion has lost control of ExecSG, i.e., that it has been acquired by a third-party." I have no proof of that, and should not have suggested I do. Nonetheless it is a fairly big claim to have been made, and I'd like to see Hyperion comment on it one way or the other.

Link is fine, but read exhibit D (the emails).

Basically Hyperion had a binary license only and no rights to the sources. Neither did AI.

Your link (2007) expressed concerns re:ownership

When this ended up in court in 2008, the following was filed:
T. Frieden, H. Frieden & A. Vallinotto v. Amiga Inc. & Hyperion VOF

Questions raised at the time, but later explained as Hans-Joerg, Thomas, and Andrea "protecting" their own IP, a safety measure of sorts.

Later talk about change in architecture led to Ben Hermans stating some licenses were tied to PPC only.

You are forgetting the buyback contract that predated the settlement. assets never transferred back to Amiga Inc. the work was never payed for in full.

Okay I understand now. That's no problem. Thanks for clarifying.

I've come across a similar rumour before where it was claimed Trevor bought it. But any one of these claims just doesn't make sense. ExecSG is the core of the OS4 kernel. So I wonder how the kernel would be seperated from the rest and sold off. The Frieden brothers work on the kernel so would they also be sold off? If ExecSG goes then the whole OS would need to go with it. At most I would say it's a bit of rumour humour.

As usual (it's not just him doing this) they always talk about what something is NOT, and never what something IS.
Maybe someone should have been more direct and just asked "who owns it and/or controls it then?"

As far as I've read over the years, ExecSG was always in third party hands. The Friedens own it as Hyperion couldn't pay them for their work so the brothers licenced it to Hyperion. Which would open it to another party approaching the Friedens to purchase it. Trevor said he did not purchase it. I take that as he did not personally so such, doesn't mean that A-Eon Technologies didn't or that another company that Trevor owns or set up didn't
I imagine a scenario like Cloanto, they didn't by the Amiga, Inc. assets, neither did Battilana. A separate company, C-A Acquisitions was created and did purchase the Amiga, Inc. assets

Mystery and melodrama...this is so Amiga.

I've heard that rumor about Trevor myself, but until somebody lays claim to it, one would have to assume it's still the property of the developers.

This is where all the "I hope Hyperion has to hand over the right to OS4 to CA Aquisitions" stuff falls apart.

Because Hyperion doesn't own all of the code in OS4.

Will you guys ever see the A1222?
Will Aeon resume using the AmigaOne moniker?
Does this matter to a MorphOS user (like myself)?

All I can say is I have popcorn.

Being their biggest deal, resulting in massive worldwide media coverage, and setting all amiga websites into uncontrollable turmoil for years....

how did CUSA get reduced to "among others"??

Is it just me? I don't get page hits for either CUSA or CommodoreUSA.
