@mac - Thank you

@bison - haha thanks man.

If someone had told me 27 years ago, that I would need a ROT translator to understand the future marketing of the Amiga - I would probably not believe them!

Cut and paste makes posting delays so much easier...

Quote:
As with all legal filings related to Amiga, this morning a new delay was filed:

Cloanto Corporation v. Intellivision Entertainment LLC

Seems that almost every month on the 26th day of the month, you are posting the same happenings. Are we trapped in a "Ground Hog Day" loop, except this is an Amiga month loop?

And the award for "The computer brand/IP most tied up in legal disputes - duration" goes to:

Amiga

This is Amiga's 15th nomination and 10th overall win.
Since the ownership of the IP is tied up in legal disputes, the Amiga Community accepts (begrudgingly) the award on behalf of the eventual owners.

Have you not heard of this one? Just because a company making a home video game console called Amico, Cloanto thinks its brand/name is too close to the Amiga brand and so wants them to use another. this video does a good job summing it up

https://www.youtube.com/watch?v=hnxXEMW1yfI

I do feel some times the copyright / ip law needs to be better, as I could maybe give Cloanto a break if they had there own Console / product on the market, but considering Amiga not even had a product on the market since 1994. I feel this is a bit of a abuse of the Amiga ip to go after companies like this one.

@amigang

Thanks for the link. I had no idea someone had made a video about this.

Sadly they failed to do any research that would show this is neither Cloanto nor Amiga Corporation's doing...

Quote:
Approached by amiga-news.de, Mike Battilana (Cloanto, Amiga Corporation) explains that this opposition was requested "by a contractual partner", and that he had no option but to heed the request.

To be fair, the video author's recollection that in over 31,000 posts on Atariage (home to Intellivision discussion) this has never been mentioned, seems to be true....as a site search for key words will show no mention.
Then again, they have enough issues without discussing a new one.

The extensions had been for 3 months periods. The former extension was reduced to 2 months. Now the current extension is only 1 month. This "may" be tied to the fact that the uspto finally completed their task to assign the "Amiga" trademark to Amiga Corporation. Prior it had been registered to Cloanto.

Cloanto nor Amiga Corporation's doing...
Approached by amiga-news.de, Mike Battilana (Cloanto, Amiga Corporation) explains that this opposition was requested "by a contractual partner".

Hmmmmmm, same excuse was used in Youtube video Copyright claims. I can understand that there could be third party involved, outside investors etc. But if Cloanto is trying to portray that they are going to be a good Ip / Trademark holder they should be doing more push back to their partners and explain that this is not a good luck. If they cant then they should give up on trying portray the good luck. Stuff like this could easily push away fans and business, just like what's happened with Amiga-Kit weird choices in the A1200 / Amiga Addict Trademark stuff.

They are pretty much forced to act when you MONETIZE videos with their copyright.

@amigang

but since Mike actually _owns_ the IP he shouldn't need to explain himself to anyone and should protect his marks.

As much as people want to hate on him for owning these marks, he was smart enough and loyal enough to the brand to fork out money for it.

He's not a thief like Hyperion or all these patent trolls..

I completely agree, by law and as owners of the IP, he / they can do what ever they want with the brand. Plus he also doesn't have to explain himself to anyone or even talk to Amiga community, we are lucky that it looks like finally we are getting a CEO more connected to the Amiga community

I just kinda wish Cloanto / Amiga did more proactive new things with the brand rather than just heavily rely on what Commodore / Amiga created. Dont get wrong they have done a good job with Amiga Forever, and supported a lot of Amiga shows / bounties and generally seem supportive of most Amiga community projects.

However I feel fan project like Amikit show how much more they could of done with there emulation package, why haven't they pushed for a complete emulation package on Android. Why dont they make a youtube channel with old Amiga Adverts / media and monetise for them self's, why didn't they commission a AmigaOs 3.1 update?

My hope is they are waiting to get this court case settled and make sure they 100% completely own Amiga that they might become more proactive. Not just become a licensing company where all the other people are doing all the work and have to pay them a small fee to use the brand. Nothing wrong with that kind a business but I feel that would be a bit a shame.

Like I said considering Amiga not even had a product on the market since 1994 that match what Amico is trying to do (which for record might be crap / scam I not really looked into it) I feel it is a bit patent trolling, again if they had a product on the market now, I could see maybe the issue, but they haven't. My guess is they may have one planned? But still it is a bit of stretch that consumers would get confused with this product for a past or future Amiga product in my opinion.

@amigang

If you're not clear on the Intellivision Amico product, simply google "Intellivision Amico" and click "video". They attend shows regularly.

If you're not sure of the connection, you can be sure Tommy knows what's going on with Amiga.
He made at least 1 video with developers from various platforms including Amiga, where he offered an Amiga developer payment to port his work to Amico.

this is their most active forum, if you're interested

I won't argue the merits of the project as there is enough of that going on daily netwide.

Amico console delayed again says CEO

In short company stated to have 60 employees all making 6 figures considers themselves too small to have any weight to get parts, due to the increasing shortages.

uhm...

Each year of delay would cost $6,000,000 minimum for labor costs with 60 employees making 6 figures. That is pretty expensive for a company surviving off t-shirt sales. The Amiga might be able to launch a Raspberry Pi Zero/Arduino competitor with custom 68k SoC ASIC for the cost of Amico delays.

Supply disruptions are real and may not be cleared anytime soon. The following video explains some of the supply disruption problems.

Why There are Now So Many Shortages (It's Not COVID)
https://www.youtube.com/watch?v=b1JlYZQG3lI

Paying more for parts is not necessarily an answer, especially when shortages are severe. Shipping to the U.S west coast is especially backup up. Chip supplies are especially backed up. Even air deliveries from Asia may be disrupted because of Covid restrictions and recent outbreaks. If Sony can't make the PS5 available in descent numbers it says something. It is a shame as demand for electronic devices has increased with Covid at the same time.

@matthey

Agree. I've been reading about other shortages neither covid nor China related.

I also read about the PS5 acquisition difficulties.

That was somewhat my point. If this company (Intellivision) considers itself small and is having these issues, then Amiga better be thinking in terms of what it -can- do, and not what it may -want- to do.

Minor change:

Although the last request was for a shorter extension:

Quote:

Intellivision Entertainment
LLC requests that this proceeding be suspended for 30 days

When granted by uspto, the actual time of suspension is listed as 60 days again.

Source of change
