Miscellaneous News   Miscellaneous News : Amiga Inc. registers Copyright Marks in Germany
posted by Raffaele on 27-Feb-2007 19:01:31 (5349 reads)
Amiganews.de reports that Amiga Inc. has registered two copyright marks in Germany last year:

- First one is named AMIGA ENABLED (register number publishes 30653991,8) on 15 December 2006.
- Second one is named AMIGA ANYWHERE (nr. 30653845,8) on 22 dec 2006 .

In the past year there were transferred these marks from Amiga Development LLC which was a subsidiary firm controlled Gateway:

powered by AMIGA (word/picture fig., 39737629.4)
- to 17.03.1999: AMIGA international, Inc., 63225 being enough
- to 08.06.2006: Amiga development LLC (n.d.Ges.d. State of Delaware), North Sioux town center, S.D., US

AMIGA OS (word mark, 39546400.5)
- to 22.01.1998: Escom AG i.K., 44867 Bochum
- to 08.06.2006: Amiga development LLC (n.d.Ges.d. State of Delaware), North Sioux town center, S.D., US

AMIGA Word/picture fig., 39532200.6
- to 01.01.1998: Escom AG i.K., 44867 Bochum
- to 28.02.2006: Amiga development LLC (n.d.Ges.d. State of Delaware), North Sioux town center, S.D., US

Word mark, 1085602
- to 18.12.1995: Commodore Amiga, Inc. (n.d.Ges.d. State of California), lot Gatos, Calif., US
- to 01.01.1998: Escom AG i.K., 44867 Bochum
- to 08.06.2006: Amiga development LLC (n.d.Ges.d. State of Delaware), North Sioux town center, S.D., US

Word mark, DD647540
- to 22.01.1998: Escom AG i.K., 44867 Bochum
- to 08.06.2006: Amiga development LLC (n.d.Ges.d. State of Delaware), North Sioux town center, S.D., US

AMIGA DOS (word mark, 1159021)
- to 18.12.1995: Commodore Amiga Inc., west Chester, Pa., US
- to 22.01.1998: Escom AG i.K., 44867 Bochum
- to 08.06.2006: Amiga development LLC (n.d.Ges.d. State of Delaware), North Sioux town center, S.D., US

-----

Personal consideration:

IMHO The mark "Amiga Enabled" sounds me strange.

Seems to me a mark to be added to brand new third party hardware "ready" and "enabled" to run Amiga OS.

the question is.......
Why now?
and why AmigaOS and AmigaDOS??

maybe noone else (like hyperion) can use the verb "amiga" in an OS in europe??

maybe the buyback option is not sufficient ??

For me it's OK. Let them do what they want to do. Personally am looking for news about Sam + os4. Hope they give them a licence.

Thanks for the news!

It appears that AInc is protecting its label which they will use for products, advertising etc.

So I guess they either believe they will use those Amiga labels in the future or they are neatening up the Amiga business to sell it off(?)

I think its interesting. At least a business move has shown up on radar!

Now... back to knitting my Boing! Ball underoos...

Will AMIGA ENABLED refer to Amiga Anywhere, or Amiga OS?

I always thought the Amiga brand was the only valuable asset Amiga Inc. really had so perhaps it makes sense to protect what is worth the most.

With all the trademark protection, etc. lately perhaps they are gearing up for some action. That would be a nice change.

A couple questions:

I understand Gateway Computers control some of the Amiga patents. So are Amiga assets being transferred (sold?) from Gateway to Amiga Inc?

Do the words "Amiga Enabled" refer to computers that will run Amiga OS but won't necessarily be called Amigas?

Yes. it is important to defend Amiga brand.

Don't forget that there are attempts to predate marks and brands once property of Commodore, or other Amiga related brands.

For example that in recent months, The Czerwinski's Merlancia Family tried to take the Boing Ball Mark in those countries in which Amiga brand has expired.

They had success in taking Boing ball in Czech Republic.

It follows the related thread here on Amigaworld.net

I posted this a while back:

They're registering marks around the world, it's not really "news". Any company worth its salt is going to register its trademarks...

UGH! That's terrible news as Czech is a good market for Amiga!

Hey, that Merlancia family doesn't have anything to do with the company that was commissioned by Amiga to draw up set top box cases? (When they were owned by Gateway?)

Well if the rumours/stories about how prone Amiga Inc's lawyers are, I'm surprised this hasn't happened sooner.

I think they're tidying themselves up, for what I have no idea but a tidy stock portfolio whether it be product or brands is definitely something that would be an attractive aspect to prospective investors/purchasers. From the consumers point of view it doesn't really matter, but it is good to see behind those closed doors there is some activity.

Agreed... but AInc hasn't shown itself to be a real business tiger. Theyve let soooo many other critical business decisions fall by the wayside, it truly looked to me like business suicide.

It would be very hard to get those marks back if lost to another company true. Same can be said about thousands of customers gone away. I think this is VERY good news that Amiga wants to live and in the future, do business. This should be a HEADLINER POST!

I've been wondering what these guys are after. There is absolutely no market for the Amiga in the Czech Republic.

There are no more "Amigas", at least not according to AInc.

Google for the phrase "amiga enabled" and you will recall that it's been used by AInc and their accomplices before, not in reference to anything related to AmigaOS, but in reference to devices with AmigaAnywhere installed. For example, if 10,000 marks had fallen for the coupon fraud, AInc said they would have given away "5 Amiga-enabled cell phones". :)

d0c probably got the true meaning of "Amiga enabled" right: Not for sale, in Limbo, held back, stopped, dysfunctional... Example: "Damn it! Some #### has Amiga Enabled the tyres on my car with a knife again. I'll have to find a safer place to park."

I think that's an odd conclusion to draw from these "news" alone. The trademarks and the other IP they're squatting on is all AInc has, and all they have ever had. What's changed, why would they be more prone to do business now than before they also registered/updated registration of their trademarks in Germany, and if it's good news why would this supposed business they'd be doing necessarily be relevant to anyone but AInc themselves and their AmigaAnywhere stuff?

Where in the hell is this referring to? Sioux Falls? If someone can identify where this is referring to exactly, I'll roadtrip down there and take pictures

I dont think that is ever going to happen.. They even said that AA was AmigaOS according to one of their latest press releases... And they still have not even bothered to update the OS4 part of their website even though OS4 is now done.
