Announcement   Announcement : Hyperion Entertainment VOF and ACube Systems Srl announce strategic partnership

Leuven, Belgium and Bassano del Grappa, Italy ñ 25 March, 2007

Hyperion Entertainment VOF and ACube Systems Srl are pleased to announce that they have entered into a strategic partnership following a recent two day meeting of representatives of both companies in Brussels, Belgium.


Within the framework of the partnership ACube will act as a worldwide distributor of Hyperion's Amiga OS 4.0 operating system for a range of PPC hardware platforms including AmigaOne (MicroA1, SE/XE) and Classic Amiga.

More details regarding the companies strategic partnership will be announced shortly.

As a software designer for embedded systems I can confirm this to be absolutely true. In fact, every new design has at least one FPGA on it. Sometimes we have even cost reduced an embedded board and added an FPGA and anybody who knows anything about cost reduction knows you don't do something like adding a part during a cost reduction cycle without a very good reason.

On the bad side of things the software configuration management is becoming more complex with all those FPGAs about. However, the cost of controlling the software is far less than the cost of reworking the hardware. ACube Systems obviously knows what it is doing with their design and are targeting today's performance embedded users. The SAM440ep could also make a decent home computer system. Seems like a real winner to me. Let's hope they can ship the boards soon and we can all find out for ourselves.

It could be that because Hyperion are not a Limited Liability company, that they are "transferring"/selling all their rights etc to ACube who are an LLC, thus absolving the owner(s) of Hyperion VOF of any legal culpability if Amiga Inc were to set the lawyers on them. An LLC can just shut it's doors and declare bankruptcy and the owners are untouchable.

Just a thought.

Sounds like a good start to me, but I hope this "range of PPC hardware platforms" they mentioned includes more that the ones the already mentioned.

Yeah, and to make sure everybody understands that Hyperion does no longer want to be legally involved with OS4, the press release mentions "Hyperion's Amiga OS 4.0 operating system" and ends with "Amiga OS 4.0 © 2001-2007 Hyperion Entertainment VOF".

Sooooo.....If I buy OS4 for my........errrr......Classic.......... and if it happens to install and run on my .....errr.......PPC mobo I just bought called a SAM somethingorother, who is the wiser?

How exactly does anybody know that I am not putting it to use on my classic?

I mean, I imagine you have to sell OS4 for classic as shrink wrapped software don't you. Even sell hundreds of thousands.... How is anyone to know that it's not getting used for a classic, and even if they did know, how would anyone go about stopping Hyperion from selling me OS4 for classic if it just happens to run on SAM? Is any kind of legal injunction valid in this instance?

Is Apple going to come down on MacOnLinux or even Eyetech, for example, if I buy MacOS to run on an A1? Is it really that different to buying Amiga Roms through Amiga Forever to use in UAE. If Pegs suddenly ran OS4 classic through a hack, who do you send the lawyers to?

Ok. Going back to my happy place now.

Maybe they should have learned from history that vague ambiguous announcments make people speculate wildly.

There's absolutely nothing even remotely vague in

"Hyperion's Amiga OS 4.0 operating system"

or

"Amiga OS 4.0 © 2001-2007 Hyperion Entertainment VOF"

- in fact, you can't be more precise than that. Yet you decided to speculate about that particular part, claiming they might not meant it the way the said it.

The way I read it was that individual dealers will buy OS4 from Acube, not from Hyperion. Hyperion will develop it, Acube will sell it. Sounds close to what you're thinking. Same way as I'd buy PowerPC chips from Arrow Electronics not from Freescale, if I were into that kind of thing.

*I* didn't claim there was.

This is the part that is leading to the speculation IMO.

Or Ppc-Mac, or Pegasos or Efika, or PearPc. I don't think this will happen, they might
gain some bucks from it but will also fear to loose some dimes because of piracy.

I presume that is everything that is yet to be announced as licensed Amiga OS4 hardware.

I think it is pretty obvious that Sam440 is one of the boards in that range but as it hasn't been announced as having a license yet it is also fairly obvious why it isn't mentioned in this release.

so lets assume we will see some kind of hardware that will go with os4.

what will happen after everyone buys it? can hyperion keep on developing to 4.1, 4.2, 4.3... etc? and avoid getting slammed by some lawsuit?
