So it's been 2 weeks since the announcement and sales are already being processed.

And yet still no word from Amiga Inc.?

What do you want to hear. its awfull and we are going to shut Hyperion and the team down, Acube and all the rest that sold OS4.1 and also the users that bought it ;p

It's puzzling to me that they haven't issued any sort of statement.

If they've settled it's to their benefit to acknowledge and promote the availability of the product. If they consider it to be a further violation of their licensing agreement and ongoing litigation then surely they would have issued a cease and desist.

Has no one even had any private dialog with Bill McEwen?

As far as I can tell, no-one's yet received a copy of OS4.1/440, so no infringement has technically happened yet (I don't think preorders count). I'm afraid that the lack of anything from Amiga Inc is a sign of them waiting for the first end user to get a copy, and that's when all the noise will start.

Why are you expecting any kind of public statement? The court case has gone non-public AFAIK, so you won't see any announcements, and this isn't the sort of thing that companies deal with loudly and publically.

We're referring to the product, not the court case.

Hyperion has either been cleared to proceed with the blessing of Amiga or this is a provocation. As mentioned, it's possible that a negative reaction would only follow availability but that would be unusual given that the court case has been dragging on for so long. The product has also been displayed in public.

The onus is ultimately on Hyperion and A-Cube to let people know what the deal is. Either the EULA is valid or people could end up having it revoked.

I've not had an Amiga for at least 5 years, since I sold my bvppc, but have always come here to keep up with the news.

This is brilliant news and as soon as I have the money I'll be straight back into the Amiga scene.:)
