@ Bobsonsirjonny

I won't bother to post within that AO thread again. My comments and many others backing / explaining Ray's or Amiga's point of view were simply deleted. Yet there comes BBRV ready to pour more oil onto the flames and his comment is still there.

I think it's all very unfortunate. I however understand that Kees is in a very difficult position.

My posts were also removed - and I didnt flame.

I am so anti flaming - I've even started going out of my way posting to diffuse situations. Its nuts - what an embarassement the community has become - and like with football hooliganism, its only a few that give us all a bad name.

Who was saying that?, but as you know meetings doesnt automaticly go in favour of the instigator you know.

Didnt say it did, though I think dismissing your countersuit (you arent disputing AI did that??) isnt something that would be described as having things go in your favor. Or are you disputing that this:

"Last week Amiga's legal counsel agreed to drop the counter claims and validate the license for the Pegasos and AmigaDE. Bill was in Montana again..."

actually occurred. Most would not take that as a win for Amiga Inc.

Quote:

as far as I and quite a few backtracking genesi representatives are concerned that is the case yes.

I should have been more exact, are you saying Amiga Inc did not drop the counterclaim in the case???

Quote:

Here is what I suggest to you, go read the actual EULA before you make comments about it.

I believe that the license agreements concerning AmigaForever & Draco, the EULA and the posting thats the subject of this post are in conflict. As people have pointed out the registration card for 3.5 has an option for UAE on it as platform (UAE is not an Amiga Branded Machine). I think you and Ray and Bill (when he gets back from Montana) and Barry need to figure out what you really meant and fix the posting.

Yes you should, better ask "your friend" to verify it this time around, not that he is able to say anything but Ill let the you two sort that out.

Now Tigger, there is no need to get into derogatory remarks about the people involved just because some people post about stuff they shouldnt realy do (its not good for "some" legal procedings you know)and I´m not talking about Amiga Inc. representatives.
AmigaForever as far as I know have a valid lic. for AmigaOS3.1, Draco and others is a totaly different matter. But both you and I know it wasnt targeted against the Draco or Amiga Forever now was it, you can play the "I dont know what you mean" game but that would be sooooo tiering wouldnt it????

I read the A.Org thread and now have a headache.

None of this changes my "wait and see" stance on the whole issue. *IF* it transpires that Genesi and Amiga Inc end up driven into the ground by this battle, Hyperion will still be there to follow through with the OS4.x project as per the publicly detailed contract and Eyetech will still be there to make AOnes. I sincerely hope this isn't what transpires as I'd dearly DEARLY love to see both camps just bloody well get on with it (this is not a criticism of either company or "camp" but rather an expression of utter exasperation at the scenario we find ourselves in.

Interested in what any of the above means.

Could you point out the derogatory remarks about People in my post, I dont see any.

Draco is another matter??? As someone that knows more then a little about Draco, I would love to hear that. And as for who the message was targeted for, sure everyone here knows it was targeted for Pegasus, but thats not what it says, and Amiga can not just decide to enforce the EULA on certain people. If they in fact attempt to block its usage on non Amiga Branded computers they will have to block it across the board, that will impact everyone using it on any platform.

Me too... I'm sorry that I even went there. It's a shame how that site is now to me like Ann.lu.

After all, it's a Genesi sponsored site, on a Genesi sponsored server, with Genesi employed owners/moderators... So I guess they can say what they please.

I don't begrudge anyone the use of their Pegasos. It is a modern day Amiga like solution. But things have gone way past that at Amiga.org. It's actually an abusive environment to those who are A1/OS4 supporters, or to anyone who supports Amigaworld.net.

I haven't read the a.org post yet, but I have just got back from the 156 odd comments on ANN, and they were just as bad. Some people really don't like people here (or the site in general) simply because it hasn't adopted a pro Genesi stance. To be fair, we don't go around knocking MOS either without reason, and we are after all set up to be an Amiga site, and so is it not logical we cover Amiga (classic and next gen) news and chat. I do not expect a vast amount of Amiga/AmigaOne related news on a MOS site, so why would they expect a vast amount of Pegasos/MOS news here?

Exactly they shouldn't. Trouble is this news involves both parties....

I am quite impressed by Bill's return statement. He did not show any discontent regarding the misleading information posted by the Genesi team, he simply wrote the Amiga community a plesant and informative message explaining that neither party had won the legal battle as yet, but that it was infact still on going. He did not try to take cheap shots at the other side, he simply stated the facts of the matter as they were at the time in a plesant way.

Quite a professional approach, I think.

Regarding Ann, I wont bother even going there - nor have I done for a long time and nor will I for the forseeable future. I have nothing against Genesi or MorphOS, infact I have much respect for it, but I am commited to AmigaOS4 and it's future. I am not interested in bickering and arguing, I just want to get on with things. I would suggest that anyone who feels the same should also stop bothering with places like ann - I feel MUCH better since I stopped going there. I'm not even tempted anymore.

Brian

I totally have not been following this one.

But, it's interesting, most everything said from Genesi has some seeds of truth. Like the whole CEO thing, with Gary Hare passing out business cards, but then again, maybe Gary Hare was mistaken.

I wanted that issue to resolve it, but so much of what BBRV had said was backed up...Gary Hare was a real person, working for Amiga, Inc...other people had the card.

So, it didn't resolve the 'integrity' issue, though it does appear that Bill McEwen remains CEO. Then again, he said he would appear at AmiWest as proof, and no one has seen the man.

Everything remains grey.

But as for this issue, saying legal matters have been resolved favorably, isn't going to anger the judge, who won't even read them or ever know about them.

I mean, get real, this isn't high profile. And such a statement can mean a lot, like, one party wanted them to continue and one party wanted them to be thrown out as frivolous.

Since they are continuing, the legal matter (of the day) was resolved favorably for Genesi.

But...thats not to say that I approve of this type of doublespeak and misleading language.

I don't like it coming from one side, which does it repeatedly...or from the other side which does it repeatedly.

Now you can guess which side is which? smiles.

Kinda what I was thinking too, Paul. If I were their lawyer, I would be combing that with a fine tooth comb to get one grain of evidence against them. Unfortunately, I think it would be concidered "irrelavant" to the case at hand. There's no law against a prankster standing at a distance yelling "nanny-nanny-boo-boo".

Now as for the posting of said trademarks on Genesi's website and the misleading wording of the links... that is another matter that could gain legal ground. But again, it would have to be under another case, I believe.

I've just been over to Ann.. I'm a fool.

After what happened earlier today on Amiga.org - and what I read on Ann I'm that wound up from all the trolling (irrespective of which camp) that I've just hit the wall - I've put a hole in the bloody plaster.

Oppinions are one thing - but hatred and flames .....

This is sooo stupid. I'm fuming. I'm gonna go for a run in the park.

I'm sorry buddy.... It usually gets me really wound up too. That's why I stay over here. It's not because I'm some blind follower, cause God know's I understand the mistakes that have been made... But we cannot change those now... only move forward. I hope you didn't hit the plaster too hard... that could break something other than the wall. Don't let it affect your personal being. As you so well reminded Mikey on AO, it's just not worth it.

Things are finally happening for our platform. We have great new (to us) hardware, and are on the edge of having the long awaited OS4. Don't let all of the other stuff get you side stepped now. Focus on the positive stuff that is really going on.

Everything else is just a "smoke and mirrors" game, designed to make you loose sight of the good stuff.
