Amigaworld.net News   Amigaworld.net News : "Hyperion and Cloanto allegedly close to finalizing settlement"
   posted by tygre on 2-Feb-2020 23:36:22 (3634 reads)
Hi all!

Finally, the end is in sight

"Business representatives of Hyperion, Cloanto, and C-A Acquisitions, Inc. have been engaged in several days of intensive face-to-face settlement discussions in Europe geared toward a global resolution of all claims [...]. Hyperion, Cloanto, and C-A Acquisitions, Inc. are finalizing changes to a negotiated term sheet, which they anticipate will soon be executed."

One more week! ;-D

Cheers!

And so the agony persists, as the two bit players remain clueless as to what they are fighting over and why.

Yay? But, I don't dare hope yet.

I think an agreement could be good for everyone.
I'd love to see UAE tech included in OS4.X I think that could be a win for both parties and
for end users.

AmigaOS4.x users have been running UAE to use 68k Amiga software and games for years, and scripts like "RunInUAE" have even allowed users to just double click an icon to run 68k software and games, from the AmigaOS4.x desktop, so I don't see how any agreement between Hyperion and Cloanto or C A Acquisitions is going to change or improve that?

As for an agreement being good for everyone, only the future will show if that is true or false.

hopefully something good can finally come out of all this legal crap

@ amigadave

+1 and we also have glUAE scripts that work great too without the need of starting up E-UAE

@ 6

so they are postponing the date it seems?

@klx300r

Basically what the 2 parties have filed is in response to the court demand of January 17, 2020 which states in part:

Quote:
Cloanto and Hyperion must each write a short
Response informing the Court of the current status of these two cases and answering the
following questions: 1) why these cases should or should not be consolidated, and 2) why Case
No. 19-cv-00683-RSM should or should not be stayed pending the resolution of the instant
action

Therefore, one would expect there to be something in the text of both filings that indicates the current status of the 2 cases.
"instant action" refers to the trademark case, currently with a default filed by the clerk.
So the judge is merely asking why the trademark case should not be suspended until the default action is resolved.

I don't see the documents uploaded anywhere currently, so I don't know the content.

Some form of detente will be a good first step but I would be a lot more enthusiastic if a single party assumed control of the IP.

With very few exceptions, the biggest problem with the Amiga "industry" has been the people. Most of them are either of questionable character or they don't have a clue of how to execute any sort of vision.

Although I'd prefer to hear what the chief judge has to say about this, I do see that Alternative Dispute Resolution (ADR) procedure is outlined court by court:

https://www.justice.gov/olp/file/827536/download

The entry for "WAW" (Western Washington District) towards bottom seems to apply.

I think you will find they are fighting about what Cheryl said about our mam at Tracy's wedding.

Cheers

@number6,

Just so I don't have to sift through all the court documents, and/or thread comments in this and so many other threads about this conflict, can you tell me what the current status of the other case is, and when is the deadline for it to begin, or be mediated?

From what you posted earlier, the case mentioned here has been "Stayed" until the other case is resolved. So I'm wondering when that "other case" might be going to trial, or a forced mediation might happen.

Any light you can shed on this would be appreciated, as I am too fed up with all of it to keep track of what is actually happening. Your diligence in watching this process is greatly appreciated.

So, how much money did they earn by suing eachother!?!
They must have earned tons of money since it made sense to keep it up for so long

@number6

Regarding this:
Quote:
As far as we know, the next step to avoid a lengthy and costly trial would be mediation involving a neutral mediator

That is what they need:

@Amigadave

I'm confused. My post #14 seems to have vanished and was replaced by text asking me questions, written and edited by you according to the edit note.

Could you please explain why?

Thanks.
