looked over at ANN.lu an user called Pietr is thinking about going MorphOS now that MorphOS runs AmigaOS4.0 software, we need to take action, we can not let MorphOS hijake new users from AmigaOS based due some emulator, can we some how control this? this OS4EMU is really unfaie to competition, is there not any legal routes that can be taken against unfaie competition? I hope so, itix has ignored ever warnings,

I know we like to see software ported from MorphOS to AmigaOS and form MorphOS to AmigaOS I think this is some thing totally different from what is going on, what is going is on is undermining the work being done on AmigaOS4.0, and I think the work being done is really worth it, I believe the key features of AmigaOS4.0 gives great value, like the memory protection, stack enlargement, clean API's, so really hope AmigaOS4.0 can overcome this problem,

Right............. and you think an API re-implementation is illegal?

I'll give you a few examples shall I?

Re-Implementation - Owner of original API/IP
Haiku - PalmSource (BeOS)
MorphOS - Amiga Inc (AmigaOS)
WINE - Microsoft (Windows)
ReactOS - Microsoft (Windows)
BSD - AT&T (UNIX)

I mention BSD specifically as an example of where a re-implementation has been taken to court and won, therefore setting a legal precedent for all future cases.

Why do you think Microsoft hasn't sued the developers of WINE & ReactOS out of existance?

No I don't... I think if you do some thing that under mind some one elses biz, then your doing some thing unfair to competition. there are rolls against unfair competition.

Didn't the A1 hardware have some special "dongle" code that was necessary for OS4 to run on it? If so, OS4 system programs are not going to run on a Peg. The only "OS4 software" that will run is applications that are not part of the OS, and that's not a problem.

Well i sure hope in the future, if Amiga Inc. is going to do any lawsuits, that protection of their IP vs MorphOS is the way to go! I am just sick and tired of this.

if user buy Peg/MorphOS and not AmigaOne/AmigaOS40 due some emulator don't you think this is problem?

and for me ill stay right here with my A1 OS4 no matter what its still the best

I don't think this is illegal as long as they are not stealing code or linking with private libs from OS4. After all, many BSD distros provide binary compatibility of Linux programs, so what's the problem? May the better OS win!

I have to say that I still don't like this at all. It's quite clear that itix don't care if his emulation damages OS4 sales. I have no respect for this project because it's timing is totally wrong. I can't understand why he can't wait until OS4 is released.

The point is it's goes under "predatory practices" / unfair competition, this has nothing to do whit copyrights or stealing code.

Linux software is GPL and the OS is free, so I don't see how BSD can harm linux, this is diffrent case,

Why should he? He would gain nothing from doing so.

He is an artist, and he has created something. He has then chosen to release his creation for others to use.

People would only not buy an A1 and use OS4EMU instead because of the price/performance ratio. Pegasos II costs less than an A1, and runs faster, it therefore has a better price/performance ratio.

Time for a port of OS4 to the Pegasos methinks, unless Eyetech dramatically reduce their prices then there will be a lot more people like Pieter on ann.lu.

It's not that simple, you don't make your mind using just one factor (price),

for example you don't eat candy for your tree meals, on the bases of it taste better,
most folks try to think about healthy diate, and think about more the just it's taste.

You don't eate dog poo even if it's free

OS4MEU can be one factor.

I'm not a lawyer, so I may be talking out the wrong end of my torso, but:


No, it doesn't.


"Predatory practices" is when you are Microsoft, and you _require_ PC manufacturers to post the icon for Internet Explorer on the Windows 95 desktop while, at the same time, you _forbid_ them from placing any other internet browser icon (say, for example, Netscape Navigator) on the desktop. You place this requirement in their Windows 95 purchase requirement with the proviso that, if they don't follow this requirement, they lose _all_ rights to sell Windows 95 on _any_ of their PCs. Since Windows 95 has, say, 90 percent of the PC market, the PC manufacturers are then _forced_ to show _only_ Internet Explorer on the PCs that they sell.

Ikir's OS4Emu doesn't come close to being "predatory practices" as he has absolutely _no_ control over the potential marketplace.

I'm not sure what you're worried about. Most of the major open-source apps are being compiled for MOS, 68k, & OS4. For those that don't have an OS4 or MOS version, the 68k version usually works. Commercial developers are interrested in money so they will probably supply OS4 and MOS versions of their software. I haven't seen any projected major applications for OS4 only. Even PageStream will offer MOS and OS4 versions. I don't think this is worth worrying about.

If programmers want to waste their time writing an emulator to run a handful of programs that don't already run on both systems, then let them. I just wish they would spend their time writing new applications instead. Face it, both MOS and OS4 have a small userbase and neither group of users will be throwing away their current computer to buy a competing system. A lot of Amiga hardware and software companies have closed their doors after they made all the profit they could from the Amiga market. Even H&P did it after they sold all the OS 3.9 updates they could. If there is to be a winner in the OS4/MOS competition, it will be the company/group that keeps their door open the longest.
