Terms, Conditions and Policies

Contents

Terms of use:
The following conditions relate to the use of this site, please read them carefully. By using this site you have agreed to these terms and conditions. If you do not agree to these terms and conditions please do not use this site.
AmigaWorld.net may modify the terms and conditions at any time, we would advise you to check this page to view these changes.

You (and not AmigaWorld.net, nor any of its respective members) assume the entire cost of any necessary servicing repair or connection arising as a result of use of the site. Applicable law may not allow the exclusion of implied warranties so the above exclusion may not apply to you.

Neither AmigaWorld.net, nor any other party involved in creating, producing, or delivering this site, shall be liable for any direct, incidental, consequential, indirect or punitive damages, costs, losses or liabilities whatsoever arising out of your access to, or use of, this site. Everything on this site is provided to you "AS IS". Neither AmigaWorld.net nor any of its members warrant the accuracy of any of the material contained in this site or that it fits any particular purpose. In addition, AmigaWorld.net shall not be liable for any damages to, or viruses that may infect, your computer equipment or other property, by reason of your use of, access to, or downloading of any material from, this site.

Neither AmigaWorld.net nor any of its members make any representations regarding the use of the results of the materials in the site in terms of their correctness, accuracy, reliability or otherwise. Neither AmigaWorld.net nor any of its staff are liable for any defamatory remarks, Section 230 of the Communications Decency Act.

Requests from our staff: At any time, if a moderator or administrator makes a request of a user, that user is expected to follow the instructions. We rarely, if ever, challenge our users to do something (usually this has to do with an inappropriate avatar or some sort of aberrant behaviour). However, when it does happen, we expect it to be followed; participate in this site, and you participate in it as a privilege, not a right. You may always PM an administrator or the webmaster to ask questions or file a complaint. However, I place great faith and trust in my staff to do the right thing. Your cooperation is appreciated.

Disciplinary procedure: The staff may issue a warning, ban or account termination if they believe, in their sole discretion, that you have violated any of the terms of this TOS, or that you have engaged in any behavior that the staff believes, in their sole discretion, is harmful to the operation of Amigaworld.net.

The disciplinary procedure for violation of the TOS is as follows. (note: some offences may warrant an instant ban or termination, where this is the case it will be indicated in the TOS below)

1. Warning
2. Final warning
3. 1st ban 7 to 14 days
4. 2nd ban 30 to 90 days
5. 3rd ban 180 days
6. Account termination

Flame/Attacks: Do not flame! Flaming refers to derogatory, abusive, threatening, sarcastic, rude, or otherwise mean-spirited messages directed at members/users. Be cautious when using sarcasm and humour. Without facial expressions and tone of voice, they do not translate easily over the Internet in posts and may be perceived as flaming. Report the flame posts immediately to an Amigaworld Team Member so that the situation can be dealt with immediately. A warning may be issued depending on the severity of flame/attacks.

Troll: Trolls show no respect for other people's opinions and deliberately crafts messages to provoke others with the intention of wasting their time and energy or just to cause anger and confrontations. There is no point in arguing with them; their minds are made up. Ignore them, and report the posts immediately to an Amigaworld Team Member. Repeat offenders may incur an instant banned.

Multiple usernames: Intentionally registering more than ONE username for the purpose of using multiple usernames is NOT allowed. This includes, but is not limited to, registering a new username to avoid a ban. Using the site (for posting messages or otherwise) with more than one username is not allowed. Users that do not follow this rule will be permanently banned. Also, do not use someone else's username, even if you were given the password to it by the owner of the username. Exceptions can be made with approval of Amigaworld.net staff, for example where the username is a company name to be shared by employees. If you would like to change your username, contact the webmaster.

Threads: Creating threads that are not related to the forum category or posts which are not related to the thread that they are submitted to is against the rules. If you wish to discuss Off-Topic issues, please use our 'Free For All' forum. Also creating threads with misleading topics is against the rules. Repeated violation of this rule after one warning may lead to moderator action.

Pornography: We do not allow posting of any material which may be deemed too risqué, objectionable or illegal to be viewed by minors, messages posted with vulgarity, explicit sexual reference, or obscene images will be deleted, and a warning will be issued. Links or references to mature content sites will be removed. Obscene and sexually explicit avatars will be removed. Help keep our forums clean, and a cut above the rest. Posting/hyperlinking very explicit content (material that is deemed very offensive, very graphic and/or illegal) will incur an instant ban.

Closed Private forums: While Amigaworld.net does not own or take responsibility of any material posted by its members, it considers information posted in private forums to be privileged information.

The information is posted with the understanding by all members with access that this information should not be copied, released, or posted outside the private forums of Amigaworld.net. Should a member want to release such information outside the private forums they should obtain the permission of the originator and the site owner.

Copyrighted Information: Copyrighted material, private email text, and other privileged information may not be posted here without prior written permission from the original author. If you find that your postings to the web site have been copied, emailed and/or publicly posted or distributed elsewhere or brought to the forums by another for posting without your permission, which constitutes violation of your privacy or copyright infringement, please notify the Webmaster directly so the situation can be promptly addressed. If such an event occurs, the individual posting the information shall be held solely responsible.

Piracy: Software piracy is strictly forbidden and is defined here as "any unauthorised copying or transfer of a computer program in any manner other than what is permitted by copyright law or by the author as stated in the software licensing agreement". This includes, but is not limited to: material protected by patent, copyright, or trade secret. Any person using this site for software piracy will have their account terminated and will be reported to BSA.

Site Netiquette: We share one common ground, we are all Amiga users! Respect other opinions, even though you may not agree. Everyone is entitled to their say, but please do so in a courteous manner. Off-topic posts will be moved to the proper forum, and further action may be taken against repeat offenders.

It's easy to flame someone if you disagree, but remember, that type of behaviour is strictly prohibited. We come from different locations, we are a mix of ages, and our backgrounds vary. Take that into consideration before you click the post button. A moment of thought is better than hours of grief. The general rule of thumb is treat others as you would like to be treated.

Spam: Spamming the forums with senseless, inane, or empty messages to increase your post count, or simply to aggravate, will not be allowed. This includes such things as chain letters and two-word "I agree" or "me too" responses. Continually posting the same topic on a particular board, and posting the same question across several forums is also considered spamming, and is a violation of this TOS.

Avatars: Avatars are 120x120 pixels and 5 KBytes maximum. Avatars must not be too risqué, offensive, pornographic, obscene, blasphemous, or breach intellectual property rights. Such avatars will be removed and a warning issued. Avatars containing very explicit images (material that is deemed very offensive, very graphic and/or illegal) will incur an instant ban.

Images in threads: Images embedded in threads should be no wider than 640 pixels, larger images should be hyperlinked. Images must not be too risqué, offensive, pornographic, obscene, blasphemous, or breach intellectual property rights. Such images will be removed and a warning issued. Posting/hyperlinking very explicit images (material that is deemed very offensive, very graphic and/or illegal) will incur an instant ban.

Moderation: A moderators say is final. When a moderation decision is made the moderator will document why either in private message or at the place where moderation occurred. This in most cases will be accompanied by reference to which Terms Of Service have been broken. Moderators are allowed to use their discretion in interpretation of the Terms Of Service and operate outside of the Terms Of Service where they see a need to intervene. Where you disagree, or feel unfairness is an issue, see Ajudication.

Adjudication: Whilst AmigaWorld.net moderation tries to be fair and balanced sometimes errors can occur. If you disagree with a specific instance where you have been moderated then please put your complaint to the Webmaster, an Administrator or another moderator for consideration and possible action. Arguments about specific moderation incidents are not tolerated on the public forum, use the adjudication process open to you.

Advertising in forums and news items: Paying sponsors and banner advertisers need not read this section.
AmigaWorld.net provides a classified advertising module which is the only place other than paid for advertising banners that adverts are permitted in. This includes promoting goods and services, links to online auctions or advertising in signatures or through avatars. If in doubt, write a classified advertisment. Press releases are considered under a different category we accept that companies have a need to propogate news and information. If you consider it newsworthy then submit it as a news item. Our moderation team will either publish it or not depending on their judgement as to its newsworthiness and let you know why they did not publish you if they decide against it. If you are directed that an item is not newsworthy, you will be instructed to either place it on the forums or in the classifieds advertisments.
