lawsuit and the $2 million they offered to settle out of court
I've ask this before in other threads.... did AI ever pull out $2million and put it on the table, or was this just a claim in a doc or news item? If AI had actually sent Hyperion a contract/bill-of-sale with a cashiers check attached, would we be in a different place today? If AI only talked about an offer of payment, then Hyperion might not have any faith that they would ever actually see it.
I might have missed it. Did anyone see a formal offering amoung the court filings?

Seriously though, I seem to recall this was purportedly proposed in an e-mail exchange between B. McEwen and some one at Hyperion. But I could be wrong. If some one else has hard facts, I'd love to hear them.

McEwen brought it up in an email, and then Hyperions lawyer made a big mistake and brought it up during the hearing. So as far the court knows its a real offer and has to be treated as such. So either Hyperions lawyer made a big mistake or it was a legitimate offer. I have already told you why I think it was turned down. -Tig
