And when did they made that complaint ? Right in 2007 when they were in desperate need for arguments against Amino.
If they had any evidence of such a complaint dating early 2002 they may have had a case. |
You are jumping to conclusions again. What was Amiga Inc.'s phone # when they were evicted out of their offices? Sometime later ITEC and KMOS appear and it seems at that time is when some behind-the-scenes dissagreements occurred. Obviously there were communications as the court documents show...and don't think that they show all communications only what they presented, hence - allowed us all to see. Hyperion played a waiting game to see if KMOS would fold as well. That much is obvious.
I think they asked for money for the buyback just to see if Amiga Inc. could produce money. The money came from everyone but Amiga Inc... That's probably where the problems began.
For instance, if I repair a car for you, I'm obliged to return it to you and only you. Even if you have someone else pay for it. Now if the terms were that if you couldn't pay for it, I would own it...having someone else pay for it and then having that someone else be the one I hand the keys to becomes a big giant grey area. The fact is - YOU never paid for it, perhaps I want to keep the car after all, why should I allow someone else to pay for it. You shouldn't have sold the title to the car before it was ready to be driven home. As a mechanic, I have a mechanic's lein on the car until the work is done and paid for. Since the car is, in a way, my property until it's paid for, you should have never sold it. ...and that's the mess we are in... |
