If you recall, they had to use "best efforts" for meet the March 2002 psuedo-deadline. If they didn't excercise best efforts, then they would have been in violation of the contract. I think they have shown to use best efforts especially when you consider the other parties: 1) changing AmigaOne hardware (with buggy hardware at that) 2) never receiving the sources to OS3.1/3.5/3.9 3) having to develop firmware for the A1
Can anyone prove that they didn't use best efforts? |
Done it before, I'll do it again.
1) First of all its not AIs problem, second of all doesnt have anything to do with making it run on Cyberstorm systems which they needed to do as well, and which they in fact state most of the OS will likely be written on 2) Oct 10, 2001 contract with Olaf for super 3.1 sources, Nov 7, 2001 Ben publically says they have everything they need for the port, Jan 30, 2008 Hyperion has yet to show they ever asked for any software after telling everyone they needed nothing. 3) See 1.
Thanks, that was fun. -Tig

Reply to your replies: 1) No, but the the point was about "best efforts" being made by Hyperion, not what's Amino's problem 2) I'd like to publically state that I'm a mechanic and I can fix this car. Who cares what he said publically, it's what Amino didn't do contractually that is the point. 3) See #1 |
