Ofcourse you edit out my mentioning of ongoing discussions before a contract is finalized. That's how you counter many points. Rather than take a point as a whole, you pick parts of it semi-out-of-context.
Amino and Hyperion didn't meet for lunch one day on Nov 3, 2001 and decide to draft and sign a contract. I'm sure it started as far back as the summer. So while Olaf may have signed the contract in October, I believe Hyperion didn't sign it until a few days after the Nov 3, 2001 Amino-Hyperion contract was signed as before that contract was signed, they's have no right to have an sources pertaining to OS3.1...
I look forward to you taking this partially out of context again. To the casual reader who only glances are arguements and counters, I'm sure he would think you 100% correct every time. |
OK Lou, heres your whole point, now hear mine. It doesnt matter when Olaf signed his contract, it was negotiated BEFORE they signed the Nov 3, 2001 contract, we know that from the date. So signing a contract in Nov 3, 2001 with full knowledge (and in fact telling everyone about it on Nov 7) that you are going to buy code from Olaf and now 6 years later claiming you found out you had to get code from Olaf after the fact is disengenous. They negotiated to buy Olafs code before they signed the contract with AI, they knew they were going to buy it, they knew how much it was going to cost (and yet until 2006 they didnt pay him a dime and as of May of 2006 they had paid him less then 10%) so implying that was a reason for the lateness of the software is silly. They made the deal (signed or unsigned) before they signed the contract with AI (Amino). -Tig

And the flip-side of your argument is that Amino signed a contract that the knew they couldn't fulfill because they couldn't even pay their own rent. If anything, it show's Amino's incompetence and Ben's genius...not that I think that of him, but I'm sure that's why he was "so confident" back then about the contract.
ps, If I only pay 90% of my minimum due on a credit card bill, I stil get hit with a late fee. Paid in full is the only stat that matters. |
