That's ok, neither do the rest of us. Basically all we know is that monies were paid. AI now claims that those funds were applied to the balance of the buy-out/buy-in. Originally I thought Hyperion was saying it was applied to other balances. Neither side kept records well enough to concretely prove either way to me. What we do have is a lot of talk about "it was understood that"....(insert lawyer commet here). What I understand is that at best both sides aren't competent in IP contracts.

Well, it's not like you'd expect getting an exclusive royalty free license to develop, market, distribute and sell another company's product for free either. I think the reasoning was something along the lines of "as payment for the development, you (Hyperion) get to keep all profit from selling the finished product, the $25K is just a symbolic sum for if/when we (AInc) decide to take development back in house".
