So while they agree that only 250$ is lacking you still go for all the Amiga has payed over as if somehow it still belongs to the same contract. As for the reality check, I never said that they can keep the money and their work, in fact what I said is that they owe the money they have received, plus interests and all that economic babble around the money owed...
Interest on $24750 exceeds $250, that was the point, two months in (at 1% a month charged by Washington courts) the interest on the money exceeds the remaining part of the money. KMOS paid an additional over 15K that Hyperion said was owed for the buyback carried out by Itec as part of trying to get this all resolved in 2006. Then Itec sends them another full $25K in 2007 and still no OS. Really think, they didnt pay them yet is a winning strategy here? -Tig
Don't you have it backwards? Yes. If I pay a bill early, the company I paid doesn't give me interest back. However they can charge me late fees if I don't pay on time. Now if it is determined that Hyperion now owns the OS, I also agree they need to give the money back with interest. As for the ITEC contract, I've stated my reasons. We'll see how the NY case plays out.
