Hello everyone,

Due to the wild speculations concerning the bankruptcy of Hyperion Entertainment I decided to contact Mr. Bert Dehandschutter myself.

According to Mr. Dehandschutter, Hyperion have started an opposition procedure. He expects the decision from the court in the end of the month.

Please read more about it on my blog:

http://oldschoolgameblog.com/2015/03/16/the-hyperion-bankruptcy-decision-at-the-end-of-the-month/

Now we have to wait and see. My bet is the Hyperion will be ok, but one can never be sure.

@AmigaOldskooler

that depends of what Mr. Dehandschutter has reported to court and if other creditors have contacted him

@thread

You might learn something from reading about Belgian Law and the "opposition" process:

Here

Just search page for "opposition".

Was it not just a mistake?

Was once in "Jail" for one. These rumours really can not be without truth? I hate this Amigastyle silence.

@AmigaOldskooler

Well done. Nice to have a clean thread with an update.

Only two more weeks of wild speculation to go.

Unfortunately, it is enforced by the court. Technically Hyperion is not in control, the court-appointed lawyer is and he is not required to make comments to anyone but the court.

Hyperion is not permitted to make any public comment until their status as controllers of the company is restored. They have said all they can while remaining within the law.

Hopefully it will be over in a few weeks.

Oh I wouldn't call it 'wild' speculation. Just the regular kind.

@thread

Just a summary of ONLY links relating to the specific declaration of bankruptcy and general info on Belgian law.

I am posting this due to numerous complaints that any on-topic info is getting impossible to locate here:

Hyperion Entertainment bankrupt?

Court statements:

original declaration of bankruptcy in German
original declaration of bankruptcy in English

Statements from users reported to be email content sent to said user from the curator:

courtesy Birbo
courtesy AmigaOldskooler-this thread

Belgian law:

An Overview of Belgian Insolvency Law and Enforcement Options

Dispute Resolution Around the World-Belgium

The latter describes opposition process and appeal clearly. Just do page search for the term "opposition" and/or "appeal".

Although there have also been multiple comments made by 2 Hyperion managing partners (past and present), I omit those links due to the obvious conflict of interest with the facts.

Finally, if anyone finds a link from the former thread (my first link) that they believe I have missed and wish to have it included in this posting, please PM with link.
Please keep any such recommendation to curator/court correspondence or public information regarding procedure.

Lets hope they are not able to wiggle out of this bankruptcy and they finally kill the wounded beast. The whole OS4 thing is so dull and unimaginative, be nice to get some more traction on classic (real) Amigas once more!

@A1200

It's my understanding that AmigaKit relies on profit from AmigaOne and Classic Amiga software and hardware to stay afloat. I don't think they'd survive if AmigaOS development stopped! You're deluded if you think the AmigaOS users and developers will simply reinvest money and time into Classic hardware/software if Hyperion are down and stay down

@realize

The mark up on the X1000 must be worth their time. I got my Classic repaired in 2013 and saw all the X1000s on test beds and workbenches everywhere! That was a lot of blood, toil and organisation to keep those X1000s going out the door. They would have taken a slice off the top to make it all worthwhile!
