Sorry I don`t understand, closing for Amiga ? Worse how ?

If about the developers on recent Amiga OS versions doing work just for the love and the respect (and to get things fixed) ? How is that wrong ?

Linux developing for same reasons also wrong then? They will sell licenses and support packages for that as well.

Well if true, it be interesting if this changes anything.

Its a shame if AmigaOS 3.3 cant come out, but then there many projects (like Apollo OS/Amikit XE) where I feel a full AmigaOS partnership would of help and made it easier for developers and fans to make cool project. Lucky people find clever ways around it and we have AROS.

I hope this end Cloanto/Amiga excuse for why they cant do more with the Amiga. Because I still think there missing some opportunities.

Looks like Amiga Corp will be talking at kickstarter on August 8th, which I think is a first in a very long time that mike willing to talk to the community.

What will he talk about that can be so interesting? Old stories from his past work decades ago and vague ideas for future "solutions"? Same story as the last 25 years or more now ?

I'm not sure those asking for comment from the parent companies understand the process.
The post (post #1) was yesterday.
People have to file and await approval.

The "near future" for further detail should be July 23.

Yeah wonder why they have to stay in court ? Who sued ? (Spoiler: In 2007, Hyperion was sued by Amiga Incorporated for trademark infringement).

But still do not understand your comment that Hyperion have stopped Cloanto from develop any new OS version (nor have i ever read about any plans from Cloanto to actually do that).

Btw: Amiga Inc also stopped Amithlon so we can clearly see the pattern here (stop any new developments).

The Hyperion 68k AmigaOS was moving toward AmigaOS 4 API compatibility and interoperability which makes AmigaOS and 3rd party Amiga development easier but it was done with Hyperion IP like AmigaOS 4 and Reaction/ClassAct. Detaching AmigaOS 4 and 68k AmigaOS cleanly may not be possible which could lead to a setback like the loss of H&P AmigaOS 3.9 IP for Hyperion's 68k AmigaOS. Ideally, the same Amiga business would obtain and be in charge of developing both versions of the AmigaOS but AmigaOS 4 is legally and by ownership nothing short of a disaster. Even if Cloanto/Amiga Corp, Hyperion and A-Eon cooperated for further AmigaOS 4 development, there are many devs Hyperion contracted to develop AmigaOS 4 with some feeling cheated by Ben shenanigans and demanding compensation for an AmigaOS that needs to be nearly free to compete with AROS and Linux. Some disputed AmigaOS 4 code made it into the Hyperion 68k AmigaOS and was removed later. While the Hyperion 68k AmigaOS sales to Amiga users was enough to sustain Hyperion for awhile, the price and questionable legal status was already enough that few Amiga businesses/entities were using it with most instead choosing free AROS or cheaper older version of the 68k AmigaOS. I also hope that Amiga Corp can obtain enough AmigaOS IP from Hyperion and devs to avoid a major setback which could also discourage the current 68k AmigaOS team who are doing a good job.

True. Amiga Corp will have pressure to provide fast results much like the new Commodore. Mike is more cautious and conservative than Christian so we will see how that works out, especially considering their recent talks in Italy. Major projects on small budgets while remaining conservative is challenging. Commodore would likely be in financial trouble were it not for employees practically working for free for the first year. The 68k AmigaOS devs were also sacrificing even though part of their efforts went to Hyperion. Some level of sacrifice is likely required to make Amiga healthy again. MAHA before MAGA for the win. Also, good guys can work together with business partners building bridges where Hyperion was predatory toward business partners and burned their bridges.

Amiga Inc sued Hyperion first is my understanding. Hyperion did not deliver AmigaOS 4 which they were contracted to deliver and I do not buy Ben's excuse that payment was short. Hyperion was struggling financially but miraculously not only obtained enough finances to survive but to sue Amiga back after Pentti Kouri died, resulting in the infamous 2009 settlement agreement. There are similarities to the settlement of the current lawsuits where Hyperion is likely being practically forced to settle due to lack of financing.

Before Cloanto obtained additional Amiga IP with the purchase of Amiga Inc IP, Cloanto may have had no license to develop the AmigaOS and likely would have had no way to distribute it outside of for emulation. Cloanto contributed to developing the AmigaOS as far back as Commodore days and Amiga Inc never objected to development of the AmigaOS for emulation which was primarily bug fixes and patches. The 2009 settlement agreement Amiga Inc was practically forced to sign, gave Hyperion perpetual exclusive rights to develop and distribute AmigaOS 3.1, with the exception of pre-existing contracted licenses. Also, the "Amiga Parties" were not allowed to compete with an "AmigaOS" of their own. However, the "Amiga Parties" is specifically defined as "Amiga, Itec or Amino" which Cloanto did not become by purchasing Amiga Inc's IP and Cloanto was grandfathered in by developing the AmigaOS at least for emulation. The poor wording of the contract left much up to interpretation. Hyperion was in a good position to argue their license under the 2009 settlement agreement but Ben messed up by licensing previous versions to AmigaOS 3.1 which are not mentioned and which with appeal Cloanto was found to have standing to sue Hyperion for copyright violations. This allowed Cloanto to demand a settlement agreement on their terms.

Amiga Inc had plans for AmigaOS 4 and wanted development to continue. Bill McEwen e-mails indicate that it was to be an additional revenue stream for Amiga Inc and there were plans for AmigaAnywhere running on AmigaOS 4. The problem was that Hyperion did not turn over the source code and control of it as contracted. I do not know the inside logic of why Amithlon was rejected but Amiga Inc did not "stop any new developments" as they were for AmigaOS 4 development.

Most of the previous Amiga fans and masses do not use an Amiga anymore. They may support Amiga development under the right conditions which may not include development for the classes as it does not make financial sense and is often viewed as a lost cause. The value of micro niche PPC AmigaOS 4 hardware is beyond ridiculous and then the classes are expected to further fund micro niche software development. RGL's THEA500 Mini and THEA1200 are closer to products for the Amiga masses but the hardware inside is lacking, unfaithful and not fully cost reduced so cheap RPi hardware using emulation of retro hardware and MiSTer FPGA hardware using simulation of retro hardware eats most of their lunch too. Uncertainty in the Amiga market due to lawsuits reduced investment so perhaps the 68k Amiga could now be resurrected like the Neo Geo AES+. Amiga development would likely be more expensive than NeoGeo AES+ development but the 68k Amiga could have exponentially more performance while retaining good compatibility, greatly improving the value and 68k Amiga hardware could likely be cost reduced more. The 68k Amiga could become like the RPi but with a large library of retro software including games. It may be possible for the same 68k hardware to support other retro 68k platforms as well with minimal additional cost.

When did Cloanto ever plan a new Amiga OS version ? Never, not even back in the 90s. It was always about the emulatio and selling UAE with "their" rom files.

Most active Amiga users do use OS 3.2 and upwards btw.

I use and support AmigaOS3.2.3 and AmigaOS4.1Update 3 and I want to see OS3.3 and OS4.2 and future updates but I don't want to hear about non stop lawsuits anymore

the love business has to be on top of all others, but i bet the actual owners of amiga could have it going just the same... if they stop doing it if it is for cloanto, was it that much love after all? ;)
