Is it not relevant that third parties are currently using AROS to avoid "official" Amiga OS because of the legal problems? And to some, AROS is not enough... at least not yet.

I am not so sure legal problems are the primary reason why Hyperion's 68k AmigaOS is avoided. There are other factors.

1. Price
a) Individuals are less willing to pay up for an AmigaOS for EOL emulation and FPGA hardware.
b) Businesses can not afford to pay up where low price products are so important.
c) The owner of the AmigaOS has pushed for free updates and talked about potential open sourcing which favors waiting for a lower price.
d) Considering the price and features, some users choose to use older AmigaOS versions which are usually adequate for the highest demand retro use.
2. Ethics
a) Can Hyperion even be trusted to handle payments after past shenanigans?
b) Why does Hyperion deserve all the profits for a product they do not own and which is developed by outside developers for free?
3. Stability
a) Hyperion could go bankrupt at anytime, potentially before sending AmigaOS purchases.
b) Support from a financially distressed Hyperion is uncertain.
4. Legal problems
a) Businesses may not be able use illegal AmigaOS copies as iComp discovered.

Legal problems are important for businesses which do appear to be avoiding the Hyperion AmigaOS including RGL, AmigaKit, iComp and the AC team but I am not so sure they would buy the Hyperion AmigaOS near the current price without legal problems. I expect Hyperion would need to provide significant discounts to gain interest. Sadly, the 68k AmigaOS is likely Hyperion's most profitable product primarily selling to individuals, at least until lawsuits bankrupt them.
