Perhaps something brought up in the 88 responses on the other website?

http://www.amiga-news.de/de/news/AN-2014-10-00028-DE.html

Maybe someone fluent in German could scan for such a possibility and report back?

To be more clear, if a name has the "Amiga" work inside, it doesn't mean that this name identify an Amiga.

Link to "original" Amiga computers is clear in case of AmigaOne.

Quote:
AmigaOS doesn't mean that you identify an Amiga when you read it, only because it contains it in the name, but it's just the o.s..

As name implies, it is OS of "original" Amiga computers.

Quote:
My opinion is that the AmigaOne machines cannot be sold as Amigas. And I've showed that AmigaOne X500 page which accurately doesn't report Amiga in any place: only AmigaOne.

Here we share the same opinion! AmigaOne is not "original" Amiga, it is attempt for its rebirth. Nothing less, nothing more.

Quote:
I repeat the most important one. If AmigaOne is brand that identify an Amiga, could the latter be used without problems.

I think most important one is, there are no other computers in production with Amiga brand - only AmigaOne. A-Eon/ACube/Hyperion don“t need rights/licence to call their computers "Amiga", because there is no competing Amiga branded product (at least since the fall of CommodoreUSA). Until this changes, AmigaOne remains sole rightful heir to the Amiga tradition.

Nothing interesting so far (usual faction disputes), but I haven“t look into it thoroughly.

Google translated pages.

Click the page links as usual for an automatic (if a bit rough) translation.

i think you could use an automatic translation to get an approximate scan, but as a person who posted there myself i can assure you that the content is similar as here, as well as sliding away to some more general subjects. still generally commenting on a-news involves more direct bitching from all parts, since there is a possibility to post anymously. personally im always using my usual nick an am logging in.

all in all there doesnt seem to be much to comment on this blog entry except the said screenshot, which also has been quite prominently posted, so no wonder.

Could we at least try to keep those in the thread I linked to in post #573?

It's not about preventing discussion. The thread exists in order to keep all on-topic info in one place for the sake of easier reference for all readers.
As it stands now, this topic gets splattered around in too many threads, where the posts are undoubedly lost for posterity, which is surely not the intent of anyone like yourself who is doing some research.

Thanks.

I already follow your thread, which is obviously interesting.

But in this discussion isn't that important to know who has the Amiga brand ownership. The only thing which is not (absolutely) clear is this:

"can the producer of the AmigaOne X500 claim that it's an Amiga, without having the risk to be sued by the owner of the Amiga brand?"

@pavlor: as I said, I prefer to do not continue this discussion. I think that all the facts were reported, and the only missing piece of the puzzle is the one that I reported above. Clarified that, all other stuff will be solved by consequence.

I think I answered that one (in my post 583). What names Hyperon can use is clearly stated in September 30 2009 Settlement Agreement, but you know that already, don“t you?

Naaa. I just reported what I'm waiting for a clarification, without adding new stuff.

If I wanted to continue the discussion, I would have replied to your post point by point, as I usually do.

Just to be clear: do not continuing the discussion doesn't mean that I don't write posts anymore. I simply don't continue to repeat the same things, which doesn't give any concrete contribute to the discussion.

Yes, I know the settlements terms. But, as I stated before, the last thing to clarify is about the usage of the Amiga word; alone. That's what I'm waiting for.

Is it OK for you too? I mean: let's wait for a new about it, before posting again.

If you know Settlement terms, you know answer to your question.

@pavlor: but in your previous messages (#565 and #583) you have gone a bit beyond the settlement.

If I have to strictly follow what the settlement states, Hyperion has the exclusive right to use ONLY the 4 Amiga "marks" ("AmigaOS," "Amiga OS," "AmigaOne," and "Amiga One"), and only in these forms. Any other use of the Amiga brand, alone or with other words (except OS and One following it), is exclusively reserved to the owner (Amiga Inc?).

So you can use AmigaOne, for example, but NOT the Amiga word alone, even when describing the AmigaOne product. That's exactly what ACube made with AmigaOne X500: use only the AmigaOne word, never reporting the Amiga word.

But that also means that nobody can claim that an AmigaOne is an Amiga. Right?

If you agree, I think that the discussion can be considered closed.

Exactly.

Because AmigaOne has Amiga in its name, its connection to "Amiga" is indisputable.

@pavlor: without doubts, and I never claimed the contrary.

There's a connection, due to the "Amiga" brand...

One thing I think is missing to a certain extent is youtube presentations of how to use both programs and shopfronts like AmiStore (something Phoenix have been quite good at providing for his storefront btw).

Handcam tubes leaves lot to be desired.

"you know what i had in mind" cannot be used as any kind of legal statement, and its legality that you are trying to prove here. again we can accept that "we know what each other has in mind" as soon as we agree, that it is a matter of opinion and accept our differences.
