Unanswered questions in the aftermath of Hyperion's bankruptcy

Hyperion's bankruptcy (and the re-organization of the company that followed it) has left many questions unanswered. There is obviously much more to add on the topic in the thread that was recently closed by moderators.

For example, what really happened, exactly? Who were involved?

And how is the process of re-organizing the company progressing? Or to connect to the statements within Hyperion's own Press Release regarding the current situation:


"albeit that some resources had to be directed away"

That served as some vague explanation to what happened at best, but directed away from what exactly? From whom?


"The company is in the process of reorganizing itself"

So how is that process going?


"by opening up its shareholdership"

So what about Hyperion's new ownership situation?


"and appointing a new exective director"

So what about Hyperion's new management situation?

As I understand it, the courts don't want to revisit issues such as this over and over. As I mentioned earlier in the thread, the company was listed as "inactive" at one point last year. (VAT as mentioned). Contrary to popular belief, the site reporting it did not take weeks and weeks and weeks for the info to trickle down TO that site.

But back to "revisiting"...What would follow is an examination of the books imo, followed by recommendations. Considering that shortly after the Hyperion initial statement (issued by beta testers at first) we heard about re-organization, a new director to be appointed, etc. These changes tend to support what I indicated above. If "recommendations" is the wrong term, feel free to substitute one you like better.


There is still much info to gather about this! Still many question marks that needs to be straightened out to exclamation marks!

Changing the legal form of a company which might have
been privately owned into shareholdership where investors
may buy shares and influence decisions of company.

Probably the one who buys share of company large enough
to be entitled to that position or on the other way someone
who will be more competent in milking out more cash out
of company's assets sort of speak.

Curator can't tell company owner what to do , he can only
offer advise and his primary job is making sure that the
debts or long term financial obligations are paid.

Curator must not disclose any private company information
or make statements that would damage the company in
any imaginable way.

If you are asking company owner of his future plans at this
point it's not going to work as I imagine the owner has to
wait and see then choose his options.

Things like ownership etc will be reflected in public documents sooner or later. And info about managing director as well. After all, that's how we first found out about Matt Leaman's true involvement in A-eon (aka "AeonKit").

I think these questions needs to be answered. And I can't imagine I'm the only one...

Let me provide you a translation from the jargon of canned business press releases to layman's speech:

"The current owner doesn't want any (more) financial liability so we will try to keep the company running using enthusiasts' money. We don't make any profit as made clear by the bankruptcy, so the shares will make the investors feel they own a piece of amigaos, but they shouldn't expect a return"

"Since we need to attract shareholders, we can't keep on the top spot the same name that let the company go bankrupt. So we'll find someone else to pretend he's the new leader with brand new strategies etc."

Is that really what you want people to do? The public record is the "Belgisch Staatsblad". It doesn't get more official than that. And this is all it has to say about Hyperion.

I.e. according to the latest information from the official publication of the Belgian Justice Department, your statement

I think moderators should be neutral, unbiased, objective, without personal interests and not power abusive, etc... so therefore I believe some people should not be in a moderator position and the possession of a banhammer.

To those who want these threads closed: You blind fanboyism is probably what has kept amiga os down. The best think YOU could hope for is Hyperion to no longer have a grip on "Amiga os4" How many years of development on this project and what we finally have a somewhat usable Operating system? Where is any software at all?
