@hyperionholding & jorit2

I think this sidebar discussion is better suited to the on-topic thread:

Hyperion forcibly deleted from Belgium's company register

@number6

I posted all there is to post with a link to an official site of the Belgian federal government.

It is pointless to elaboratoe on this issue.

Naaa, I read it. And I read other analyses of this issue before.

I learned the hard way not to lend too much credence to your interpretation of law and contracts and what not. And don't bother replying to this, it's pointless.

Law for small business ?

Dunno. Ben keeps quoting million dollar figures, and he's involved in worldwide litigation(s), so I'm not sure whether Hyperion qualifies as a small business.

Re:post #476 this thread and the 2 month delay

Although Pacer documents require payment, Justia has posted this particular document for all to read/free, which explains "why" the delay.

Some more recent filings mentioned

Secondary to the Amiga trademark battle, nevertheless, since I posted Cloanto's U.K. filings, and mentioned Amigakit's Benelux filing in this thread, it's somewhat on topic.

Another filing I believe that I missed earlier:

http://www.wipo.int/branddb/en/

Enter "Amiga" for brand.

You should see "Amiga" (Germany) from Hyperion Entertainment C.V.B.A.

Based on the above and the following comment from Ben:

Source

Quote:
Why do you feel the need to file "Amiga" trademarks?

(attributed to Ben Hermans)

I guess the German filing for Amiga by Hyperion Entertainment was done due to low low low expectation of Itec LLC bothering to renew the Amiga Inc. "Amiga" (euipo) mark?

Enter: Amiga

For the readers of this thread who don't have the patience to really read it all, or do their own research, in your opinion, what has all of this recent legal filings done to harm, or improve the relationships between Hyperion Entertainment, A-Eon/AmigaKit, Colanto, and anyone else who appears to be trying to obtain, or retain the Amiga trademarks?

From the little bit I have read, it is not clear that A-Eon/AmigaKit are working with Hyperion Entertainment in opposition to the actions of Colanto, or if they are working toward obtaining trademarks for their own benefit, in opposition to all others involved.

What a huge cluster frak!

I realize this thread holds a lot of information, with much of it being a snapshot in time. As a result, some of the information is irrelevant at a later date than the original posting. I further appreciate that some people might have to translate postings, perhaps losing some accuracy along the way of understanding.

iirc, the only "companies" who have made general statements about the general reasoning for all of this are (1)Hyperion Entertainment C.V.B.A. on their home page and (2)Reed Smith's attorneys regarding their work on the closing of the Pentti Kouri estate.

Since I can not relate any private communications, and those would only serve to complicate one's analysis further, we are left with what is public (above).

If you are trying to determine whether something is being done out of spite vs as a strategic move in a larger overall plan, you'll have to draw your own conclusions.

Oh, I'm sure some of the filings are motivated by spite, but all I was really asking you was for your educated opinion on how all of this has affected the relationships between Hyperion Entertainment and A-Eon/AmigaKit (since they depend on each other's survival, to some degree), and between A-Eon/AmigaKit and Colanto, which to my limited perception, seemed to have a friendly and cooperative relationship with each other in the past.

If you feel that you cannot share your own personal opinion on this subject without diminishing your ability to gather information from inside sources, I understand your reluctance to give your opinion.

@BoingBear

Again, snapshot in time. Anything regarding any relationship could have changed since this all began in 2009. We have no way of knowing whether any talk subsequent to the failure of talks at Amiga32 has led to any change in how they look at one another.

But as of December 31, 2017 when the official statement was made:

Quote:
Hyperion Entertainment is perplexed

indicates they have no clue why Cloanto is upset with them as of that date.

As several of the other combatants are indeed businesses, I'm sure they have every much the same right to post publically their stance. They simply choose not to.
