I must admit I was a bit bewildered why court paperwork due on October 19, never got recorded.

Joinder of Parties due by 10/19/2018, Amended Pleadings due by 10/19/2018,

They just paid their debts if they wanted to avoid troubles with justice, nothing more nothing less.

That makes me nostalgic,

No evidence of return of "snowman maker", "PanetZ" and AA,DE or what ever they called it.

@K-L

An almost nonexistent company (for years) suddenly paying off a half a million dollars tax debt is something more than "just paying their debts".

It is a significant amount of money, especially given the (what must be) minuscule sales related to Amiga in recent years. I wonder who is behind all this and what the plan is. It cannot just be paying the debts, there are surely more money into it related to the ongoing legal issues and also to cover for some future plan.

@hth313

They probably are just interested in retro gears. Seeing that all companies do mini computers or consoles. There’s maybe some money to make here.

guys, correct me if im wrong, but i fear all that this has and will continue to have fairly little to do with anything anyone here considers "amiga" or the future of it. whoever sticks to observe these matters and make their choices based on their outcome, just make themselves dependant on unrelated turns of events.

@wawa

I am not going to correct you, because I think you are right.

Whatever they are cooking up is almost certainly not what we would hope for. That is easy to see as there is way too little money in it. If we want something Amiga, it will be up to us. You can either be happy with what there are or try to form some future where you want it to be.

About forming any future, I think the best hope is AROS and it is also something we as a community can control.

What I read in the amended claim is also how I always understood the settlement between Amiga and Hyperion.

So we really run the risk here not only that Hyperion cannot sell & further develop 3.1.4 anymore, but if Amiga gets their desire, even the original settlement becomes void, meaning also the status of AmigaOS 4.x becomes very unclear.

I guess, IMHO, we have Ben to thank (blame) for this, acting outside the boundaries of the settlement... All just, as he openly admitted, because he wants to earn as much invested money back as possible. And 3.1.4 I guess has already proven to be a decent revenue source. He should have indeed let sleeping dogs die as the twitter account suggests.

If everything ends up at Amiga, I guess the real end of Amiga(OS) may be near. Or would they have turned into a noble entity and release everything as Open Source...? One can naively dream no :)

I wonder when Amiga will mean FriendOS and why Cloanto does not get a cease and desist while basically doing the same as Hyperion with their romchips and the floppies or CF card that comes with it.

FriendOS is not AmigaOS, FriendOS is a fancy web page.

@NutsAboutAmiga

FriendOS is way more than a fancy webpage ( not that I care as an Amigan )

Read what they want to be and read what AmigaAnywhere Aka AmigaOS 5 was supposed to be. It fits. And that 500k had to come from somewhere. It is speculation but not an unthinkable one. And the specific use of the word “friend” and not “girlfriend” ?

I think it is clear someone is after the name AmigaOS and not so much after what is stands for today in the form of a romchip and an OS that has a few thousand obsessed users ( guilty as charged ) .

Seems to have been a focus first on what Amino had filed. Now the focus moved to what Amiga Inc. has filed. Aren't we forgetting someone?

Itec LLC (the gaggle of Reed Smith attorneys acting for the Kouri estate) joined the fray as well, according to the last set of documents linked above.
That makes for a complete collection of the "Amiga parties", as we know them.

Initially Itec LLC had suspended proceedings against Cloanto in the U.S.
Source "Motion to suspend granted"

I'm not saying it means anything, just that it's interesting.

Indeed, also reading Amiga Inc.'s document one comes to think along the lines of "the enemy of my enemy is my friend". Pure speculation, obviously: Given that the "Amiga parties" don't have much of a clue about the Amiga, Cloanto might have turned out to be useful for them gathering all breaches of the settlement agreement by Hyperion.

This does not look like a fight over some trademarks or other rights, or Amiga suddenly being worth something it wasn't until yesterday. Trademarks have to be mentioned, since they are part of the merits of the settlement agreement, but this is not what it is all about, if you look at the big picture.

I think this is the late revenge of BME and the other investors against those who robbed them in 2009. Some people really dislike the "psychopath lawyer". I think it's personal.

No matter what, Hyperion can give itself a big pat on the back for suing them again in 2017.

So they inject 500000$ after 10 years to spend some more money on lawyers with an uncertain outcome for revenge ?

Newsflash - they never did!
(develop that is - of course they will sell whatever they can get away with, and then some)
