In the now remaining case,Hyperion is the plaintiff and it seems (although I may not be sure) they are seeking damages and fees which could be awarded if Hyperion wins the case. Those damages and fees could cover the litigation legal expenses.

But now if Hyperion loses the case, then the other party maybe awarded compensatory damages and fees. In that situation Hyperion could incur legal costs.

For real entertainment, we can speculate whether Hyperion's sudden urge to get its papers in order is merely because Cloanto documented in at least one case that Hyperion wasn't allowed to conduct business as long as it was delisted (or whatever the right term is).

Legal fees will be incurred win or lose on both sides. It becomes more of a matter of who is paying the bill and when.

With insurance claims, lawyers know in advance that it will take months. With this case, I doubt they are holding off on billing based on contingency since there is no set time frame for resolution.

What, yet another company? When did that ever work?

What is needed is just time. Maybe our grandchildren will one day be able to enjoy a free (libre) AmigaOS, though I doubt they will see the point. Our generation will for sure end our lives with nothing accomplished in this regard.

If Cloanto goes bankrupt, nothing will happen, WinUAE is open source its available. People will continue to work on it. Sure it be sad if can't buy collection of old software (Amiga Forever) as bundle anymore.

3.X was closed and stays closed officially

AmigaOS stays how it is (nothing new)

That would be really bad news for me.


However, nobody posted important question: who are creditors of Hyperion? I wouldn´t be surprised, if at least part of the debt is owed to someone close to the company.

the creditors are almost as secret as the number of sold licenses ;)

But I assume Amigakit/A-eon is a big creditor because they mentioned a number of times that they gave money in advance what qualifies for creditor

Example I guess could be prebuying of 4.2 for X1000 (what propably never becomes reality, at least not with the promised features)

That is exactly what I had in mind.

Cloanto does next to nothing with OS3 for the last 15 years and then is surprised when Hyperion starts new development? That doesn´t show Cloanto in best light...

Amiga forums work this way since... well, the usenet days. To be fair, nobody in charge of the Amiga companies is an angel without taint. Ego and messianism in deadly mix.
