I can only hope that Amiga Inc. will sign another contract giving Hyperion the rights to the hardware if Amiga Inc. doesn't deliver.

They have the sources for 3.1. They don't have the sources for 3.5 and 3.9 or Amithlon because of the ongoing battles with Haage and Partner.

So many legal battles, it's hard to keep them all straight, isn't it?

I wonder what Hyperion's most ambitious project ever is? Hopefully it's some bleeding edge hardware.

If memory serves, Gateway retained the hardware patents when
the current Amiga Inc purchased the Amiga name and OS away
from them. They got the remaining A1200s and such that still
existed but they never really owned any of the custom chip
designs that made up the original Amiga hardware.
(I could be wrong about this, but I don't believe so.)

So basically today, there is no specific hardware platform that
Hyperion would need a license to use. The "AmigaONE" is more
of a target spec, than a proprietary hardware platform. Any new
line of "AmigaONE" machines that Hyperion chooses to support,
could be just about anything. Personally whatever they do support
next I hope it will be powerful, reasonably priced and easily
available worldwide.

English is also not my first language, but this is legal text, so probably only lawyers know exactly what it means. But if Hyperion, as the text says "is granted an exclusive, perpetual, worldwide right to AmigaOS 3.1", then how could somebody else be the "owner" of "AmigaOS 3.1", if they don't have any rights to it, since Hyperion has "exclusive" rights, which means they alone have the rights exclusively to AmigaOS 3.1. I think you mentioned Cloanto as an example. If Hyperion have exclusive rights to 3.1, then Cloanto would not have the right to distribute 3.1 as part of the Amiga Forever package, without asking Hyperion's permission to do so. If somebody else distributes 3.1 or any part of it, that would violate Hyperion's exclusive rights, wouldn't it?

OS4 looks like it is set to get better over time.

I hope enough money is made from this ambitious project to ensure that they keep on existing as a company and that improved versions come out.

It stands a much better chance if people can buy it at a cheap price, i.e. on ARM, which would be in contrast to the price now. From a business point of view, it would be better if it were a cheap option. Mac is an alternative to windows, but it is costly.

As I understand it Hyperion has full rights to use AmigaOS 3.1 to develop and sell their AmigaOS 4 and subsequent versions of AmigaOS 4. I.e. they do not have rights to sell AmigaOS 3.1. I dont even know why Hyperion would want to do that because their interest is on 4.x and they wanted only secure 4.x development not mess with old Amigas.

Anyway if Cloanto can not distribute 3.1 without Hyperion's permission Cloanto can always switch to 3.0 only (if there would be problems with 3.1 licensing).
