@Thom_Holwerda: not to mention it took hundreds of talented people several years of work to create Android and/or webOS... Seeing they can't even create a simple nice-looking website, I doubt very much they could release any sort of OS... even though they had the money.

Hmmmm, "scam company" ? I would define that as "takes money without delivering goods"

AFAIK noone has yet paid NotC=USA a single ct. But on the other side......

"breaking the law", now if your talking bout the use of trademarks in competition to Hyperion's licence, those are not written into any "law" but just a in a contract (the settlement) between 2 companies (AInc and Hyperion) whole different matter.

Wether that settlement has been broken by AInc/NotC=USA or wether it's even valid at all can only be determintated by bringing it up to (yet another) civil court.

My definition is different than yours then.. It is misleading to sell these systems as Amigas running Workbench when they are in fact most likely running a flavour of linux which has nothing to do with Amiga at all.
Workbench is a major component of Amiga OS, so it would be a breach of some laws if they actually call the OS Workbench 5.

Not more misleading as every TV-commercial ....

In the end you (should) get what you paid for (and what was promised). A crappy PC with Linux and a few odd-window-decoration named after a 25 year old desktop.

Maybe notnice, but still far far away from deserving "scam".

but we have seen millions cases lkie that, rebranding stuff is a common practice. alas. and it is perfectly legal. if cusa have legal titles to use trademarks involved or use names that none can lagally pervent them from, then they are not beaking the law, only your particular expectations and/or maybe illussions. grow up and see the difference.

not that i want anything from them, cusa.

If you don't believe me, go and try it yourself. The file-manager is called Wanderer, but AROS does have a "Workbench screen".

Unless you're 100% sure someone is breaking the law, then don't make serious accusations like that.

Either way it is a BIG difference when you call the entire OS Workbench when it is a direct COMPETITOR of Hyperion/Amiga OS.

"Workbench" in relation to the *original* Amiga appears to be a dead trademark if you search through TESS at the USPTO. It was first registered in 1990 by:

From my limited knowledge of US trademark law, it would mean that C-USA needs permission from Cloanto in order to use this trademark. Of course, as far as I know, you're free to use whatever trademark you want *until* the owners ask you not to, so as long as Cloanto is okay with it (and for now, they are), C-USA is NOT breaking ANY law by using the Workbench trademark.

thanks for clearing that up..
Sounds like the system is completely ####ed up then.

I for one certainly hope they never got any license from Cloanto.
Even if what they are doing is technically legal it is still very misleading and wrong in my opinion.
I really dont understand their logic as it will in the end drive users away when they notice it is nothing but a linux box.

Not exactly the same is it?? That would be like someone suing microsoft because it did not run some win16 game from win3.x days or someone suing apple because latest OSX did not run some classic mac os game.
