I supplied the link to amiganews.de for the sole purpose of providing the source article for what Rob was commenting on. I did this because linking to 2nd hand discussions just puts you one step further away from what was actually stated.
I did not offer the link in order to argue about Hyperion's status. THAT part is also information that has changed over time. One of the current links that refers to what you just posted:

What assets would that be...
...the name "AmigaOS"? Hyperion doesn't have that any more than Cloanto does. Note that Cloanto's US registration of the term "Amiga" was initially accepted, while Hyperion's attempt to register "AmigaOS" was denied.
...the 3.1 source code? Cloanto already has that.
...the code for 4.1 FE? Hyperion doesn't own any of that, it's owned by the external developers who licensed it to Hyperion. Buying Hyperion - including all their debts - to get your hands on those licenses looks quite expensive to me. It might be a lot cheaper and certainly less risky to just wait until Hyperion is history and then negotiate new licenses with the external developers.
But "Cloanto obtaining Hyperion's assets" requires two things: Hyperion going down, and Cloanto actually being interested at all. At least one of those things is extremely unlikely - I'll leave it up to you to decide which one. |

Again, please don't mix up copyright and trademarks, they are two different IP concepts. And yes, you can trademark-protect almost anything. Wordmarks (any word), graphical symbols, even colors and sound and music. But only for use in your particular industry. There are for instance several examples of the use of "Amiga" in various industries beyond Computers, and that is totally fine. You can build and market excavators and bulldozers, but if you paint them in a certain yellow color you will get Caterpillar's lawyers chasing after you. You are talking about OS4 now? Hyperion indeed sells and distribute an operating system.
Cloanto however owns OS3.1 (any and all components, source code and binaries).

Hehe, today everyone has the source code, even if they won't admit it! How about you, you don't have it?
Unlike others however, Cloanto have the rights to actually use it, since they are the owners of the Copyright! They owns it, they own OS 3.1!

For those interested, OS3.9BB2 is still available on the H/P website, OS3.9BB1 can be downloaded from archived version of amiga.com. |

| This whole trying to dictate the "amiga" market thing will be the death of Hyperion. Its getting tiring and most people are slowly but surely turning against them.
Unfortunately its us, the users who are suffering because of it. Some of us simply arent interested in their version of AmigaOS. Trying to force us to be their patrons by making our hobby be more difficult won't work, and is in fact much more likely to backfire. |

Hyperion is not the only one to blame in this case. Hyperion was rather complacent in the field of trademarks until Cloanto registered "Amiga" trademark threatening Hyperion´s core market. |

They really look like a sad child that does not get what he wants, now sees he's losing against Apollo, and starts to frustrate everyone and everything...
Makes me wonder whether Trump is Hyperion shareholder....

Apollo plays no role here. If Hyperion really targeted Apollo, "ApolloOS" would be the first victim (and rightly so). Blame Cloanto, who started this circus earlier this year and now everyone went crazy to secure their assets. |

Oh, I don't require it. I have a full 3.x install on an A4000 and a 4.x install on a Micro. I was just trying to help people, as you were.
But you bring up a good point I think. I also avoided a direct link to the files because erm....
@Hyperion/Cloanto/Haage&Partner and any individual developers protecting their own IP...
If you take issue with people posting any direct links to OS3.x material these days, due the legal wranglings...Please PM the following and they will do their best to edit posts.

I know, but it seems they're on a mission to frustrate anything Classic, out of frustration of not having enough AOS4 market share.
Where you see that other companies slowly start to come together to maybe sometimes consider some sort of joint Amiga intiative, Hyperion is acting stupid and simply frustrating all this.
Cloanto, Jens & P96, this, etc.
It seems they rather drag the whole community with them in their abyss then setting their own stake a side a bit and support the community as a whole.
