The pertinent issue would be if Hyperion used Cloanto's Personal Paint to do the straight up Boing Ball or another program.

I just post the links and seldom comment on them, but...
Reading Itec LLC's objection and Cloanto's objection, it's like they're seeing 2 different things.

I also positively loved Itec section 8:

I really don't care if lawyers can say identical=resembles. It just does not in anything "resembling" the real world.

All of this "action" before the USPTO has become irrelevant.

These issues are now pending in federal court of the Western District of WA in Seattle.

You would know that if you actually bothered to consult the court documents which are accessible to anybody who cares to get hold of them.

I love the Boing Ball and original Amiga checkmark..can't Cloanto and Hyperion flip a coin on who takes what and save alot of money wasted on lawyers

and i suspect the hyperion partners would rather be spending money on things other than having to fight cloanto and others undermining their legal rights. as would those of us who want to see our platform not be pushed even further into the ground by this crap.

[EDIT] I don't understand why Hyperion cares for this logo, the most recognizable by the general public of those is the italicized AMIGA logo on classic Amiga cases, along with the checkmark. Those were the glory days. I think they look better too.

I admit - it took me a while to see it but it is upside down and tilted counterclockwise.

The checkmark was abandoned when cbm died, it has not been in commercial use since then and has been used pretty much as public domain ever since.

Hyperion is not banned from trading.

I understand that you are not anybody who checks information before running with it but with a limited bit of research you could find that out.
