who owns the rights to the boing ball now? Does anybody actually hold the copyright on it? If that was the case surely you would need to ask their permission?
The reason I ask is that my user group (Midlands Amiga Group) incorporate the boing into the logo. The image has been deemed by Cafepress (the people who make tshirts and things out of your images) as being "a possible violation of the CafePress.com Content Usage Policy"

It's similar to one I animated using LightWave. Check out the 'Amiga Pulse' anim at the bottom of This Page. If there's anything in this you would like to use, please feel free.

I didn't design it, I just made small changes to the colouring, to make it more like the OS4 boing ball... I'm fine with having it used in the AmgaGuide however you'd have to check that with the original creator...

The amiga guide magazine, but i think designer decided not use it. amiga inc would probably sue us dead or something, even if it is free advertisement ^^
@DBAlex
Thanks. I like it.
--- However, one could probably argue thats not the boing ball logo they copyrighted. Last edited by mike on 12-May-2008 at 05:36 PM. Last edited by mike on 12-May-2008 at 05:33 PM.

Bah, just dare them
But with hindsight regarding the current AInc. I guess you are right, they would sue
Moving this to "amiga general chat" forum btw.Last edited by tomazkid on 14-May-2008 at 10:34 PM.

hehe yeah, but with the current situation, i really dont want to deal with them. You know somethings wrong when the you find the only thing standing in the way of amiga development is amiga inc. _________________ C= Amiga addict ,,, (Oo) ⎛☮ໄ ﮑὠՀ Couldn't care less what other people think, seeing that there's concrete evidence they don't. |

That is a good question...
Who owns the boing ball logo, does anyone know or have evidence that Amiga Inc. have the copyright, rights, or whatever over the boing ball?
It would be interesting to know...

Was not Merlancia trying (just one year ago) to acquire worldwide copyright of the BoingBall Logo?
If I remember well, there is some documents on the internet somewhere stating that they got the copyright of Boingball in Czech Country, where the Amiga brand and Logo were not registered.
Now, If just me or someone else could had find where are the forum discussions about it... Last edited by Raffaele on 15-Jun-2008 at 08:42 PM. Last edited by Raffaele on 15-Jun-2008 at 08:40 PM.

according to a post on AW in May of 2008:
Quote:
Yes. The Boing Ball logo is one of the things that Amiga Inc. (Delaware) has deposed to the USPTO.For the story, the status of this trademark is somehow "on hold", as it has been opposed by Hyperion (but both Amiga Inc. and Hyperion VOF are in negociation about this now for the upcoming months). |
However, I think the thread you are looking for is the one titled Amiga trying to register Boing ball as their trademark

Ouch! So it means in the US Amiga Inc. does not "own" anymore:
BoingBall (Logo) AMIGA (Mark) AMIGA (Logo + Wording) AMIGA ENABLED (Mark) AMIGA ANYWHERE (Mark)
Does this affect Hyperion's license in some way?
The above should expire in other countries soon as well..

The following notice (present in all those links) should be noted as well: Quote:
CAUTION: Although federal registration for this particular filing is inactive, the mark may still enjoy common law rights, or may have been applied for again in a separate application. Further research may be warranted to determine where this mark is truly abandoned in commerce. |
