but its pretty basic in the US for a lawyer to layer his defense.
I see another angle to this beyond layered defense..... Section 1, why the injunction is invalid. Section 2, why Amiga Inc is invalid and why Hyperion retains it's property. Section 3, why (because of section 2) Hyperion now owns OS4 and is owed expenses by Amiga Inc.
More of a path to ultimate victory in steps, and "just how far can we get."

that means the burden of proof is now on Hyperion. And while it may be difficult for AI to prove that everything was above-board due to lack of documentation, I suspect it will be even more difficult for Hyperion to prove the negative,
Virual layer Plaz concures with virtual lawer umisef here. Hyperion makes a compeling case in counter claims but will bear burden of proof. They'll need to come up with all the documents needed to make their points and present them to the court. Looks like they're prepared to do that so far.
I'm sure Amiga Inc isn't finished either and will be back with more ammo. But I have to give Hyperion high marks so far for making the best presentations.
