And surely you arent arguing that a delivery years later is a best effort? |
Perhaps. Originally OS4 was supposed to be noting more than a straight port of OS3.1, IIRC. Nobody seemed happy with that so things changed.
|
I think there is no evidence that Amino wouldnt have been happy with 3.1 on the PPC cards in March of 2002.

Nothing I've heard so far states that AI were all that unhappy with Hyperion's vision for OS4 until relatively recently. And by that I mean within roughly a year prior to AI's legal action against Hyperion. Yes there were concerns, but nothing 'deal' breaking.

Itec bought the OS back in 2003, and KMOS has been asking for it pretty much all the time since 2004. Its really difficult for me to look at the documents saying give us our OS, that have been going back and forth for most of 4 years and say that AI was happy with the situation.

FYI, I was using samface's analogy, not my own.

You took Samfaces analogy and made it even less like real life, which is fairly impressive.

I also am curious to know if there were correspondence that made clear that these four separate entities were paying towards the buy-back?
|
There is a receipt for the OS buyback for 22500 which should have been 22250 from Hyperion to Itec. Both the Tachyon and the Itec checks specificially say they are for the buyback. The $8850 according to the letter accompanying it is in direct response to what Ben is asking for as the still due amount for the buyback.

Also, did Hyperion not do other contract work at the behest of AI like the PDA port? I thought that was the basis for Hyperion's confusion as to what funds went toward what contract?
|
PDA port was paid in advance per the contract and according to the principles. So there is no backdebt for the PDA, and Itec bought the OS long before the PDA deal came up.

At least that how I remember Hyperion's position. Again, keep in mind, I'm giving Hyperion the benefit of the doubt as I only doubt AI at this point in time.
|
Thats a good plan, I mean after all Hyperion just has delivered software 10x later then schedule while not paying there people, I mean think what KMOS has done to you?

I just can not accept that AI deserve more benefit of the doubt than Hyperion. The scales just don't balance out in my opinion.

As far as I know the new AI has sent shirts they didnt owe to people, offered to honor the coupons and got Bill McEwen to not be CEO. Shoot thats a better track record then Hyperion in my book. -Tig_________________ We played the first thing that came to our heads, it just happened to be the best song in the world. |
