I don't think it was a beta of 3.9 that Ratte used to make the ROM used in the video.
As daydreamer said, the copyright info in the boot anim said "(c)2006", I'd hazard a guess and say he used a normal 40.63 ROM with updates from 3.9bb2 and (stupidly)changed the copyright info by himself.
IANAL, but changing the copyright notice is the only thing I believe the great filing cabinet can complain about, but that still doesn't warrant having the whole friggin thread removed on the A1k.org forums.

I didn't say so. Only the fact that it was called "3.9 ROM" might have caused Amiga Inc. (who apparently don't have any clue what it really was about) to call their lawyer.

In fact, the ROM-image can be put together by anybody who has access to kickstart 3.1, OS 3.9, BB2 and a few (inofficial) updates of some libraries. This is nothing new and has been done before. The only thing new about it was that it was hacked to be 68000-compatible.

With "unknown legal status" I was mainly referring to the recent updates/betas of workbench.library and icon.library.

Its simple that Bill Mc Ewen has no clue what his company is doing, and he thought that it was a "Internal release" from his own company.

And it seems that Amiga Inc is now based in California

Oooh.. now Googling about turns up something interesting..

That address turns out to be a holiday lodging called Wine Country Unlimited (last listing on the page)

Now do a reverse phone# lookup on the number listed it's Garry Hare

WTF is going on?
