The Buyback accounting:


Bill McEwan Wires $ 2,500.00 19Mar 2003
Penti Wires $ 2,250.00 03Apr 2003
Penti Wires $ 20,000.00 05May 2003
----------
Total Paid $ 24,750.00
Balance due $ 250.00

Before other open Invoices

no more funds paid until about 21Nov 2006
Amiga tries to screw Hyperion out of $250.00 or makes a mistake (2,250.00 instead of 2,500.00) .
That will prove to be a very expensive $250.00
thus up to 20 November 2006 the buyback has not been fully paid for.

I haven't actually followed all this too deeply (to much info IMHO) but browsing all these things online makes me think that this may be a golden opportunity for unpaid OS4 developer to drop Hyperion and sign up with Amiga Inc. Raise an ultimatum - "pay up before date x, or I will sell my code to Amiga Inc instead". That is - if they can get a guarantee (preferably from their local bank) that there actually are money sitting in an account waiting for them...

AMiga Inc terminated the contract still owing approx $3167.00 before the buyback and other outstand Invoices were cleared.
Thus the os 4.0 Source code should belongs to Hyperion.

Where is the $3167.00 figure from? I must have missed that... Is that still owed AFTER the extra payments from Amiga Inc.

Also, while there was some miscommunication somewhere and Amiga Inc accidentally paid $22,250 to Hyperion when they meant to pay $22,500, Hyperion DID issue them with a receipt for the full amount - they can't take that back. And it specifies that the amount was definitely for the buyback agreement and not some other debt.

But even if the buyback hasn't taken place the agreement only allows Hyperion to sell OS4 for the AmigaOne and Phase5/DCE PowerPC accelerators. Yes, the new work on the OS remains with them but they could not produce a version for the Sam using the Amiga trademarks and/or any Amiga-owned IP within the OS. Something which could prove impossible when they used OS3.1 sources as a starting block.

Not surprising, A welcome move as it has a good user base and the rest is PPC & looks good,
can carry it around for AMIGA OS Demo.

2Million is 80 x 25,000 so who cares if AOS is worth 2billion, people build products under contracts
like PS3 that after all its sales will reach Billions of Dollars but the contractors never see
the millions let alone more, so settle and let Pease Enter The AMIGA space.

There may be a payment of 7000 odd that has so far not been documented.

It does seem that the buyback was short 250.00 before applying outstanding debts. up to november 2006.

it appears as if the old amount of 5000.00 was remembered after the 2500.00 + 2250+20,000. Carton raises the 22,500 should be 22,250 issue in his latest declaration. Ben Hermans mentions 22,500 in his email of 2004 and Bill McEwans 2500 is lost in the shuffle. These things do happen.Both sides made accounting errors with money from three sources for one deal.(it just happens to be 250.00 in favour of Hyperions claims to full amount not being paid)

I read that Amiga Inc offered $2,000,000 to Hyperion. Hyperion's debt to the Friedens is about ~$750,000 which can be covered by that 2 million, then of course there are a lot of other people who needs to be paid as well. How much to Olaf Barthel? About the same amount? You are counting nickels and dimes (with decimals and all), like *that* kind of sums would matter to anyone in this case...

Besides, isn't it becoming obvious that there are *three* parts in this case;
1) Amiga Inc
2) Hyperion, and third...
3) ...the OS4 Developers!

IMHO, if the OS4 source code should belong to anyone, I think it should belong to the OS4 Developers until they get paid for it (either by Hyperion, or if Amiga buys their contracts in front of Hyperion's nose).

Its so funny how we forget the seemingly MOST important group of ALL while we play virtual management !!! LOL!

What I am pointing out is that Hyperion was only sent $24,750.00 by the 3 Amiga (Bill and Penti) wires before 2006. It means that they had not covered the buyback price up to then. If this is the case then no buyback was completed from 2003-2006. If this is correct then the November 2006 termination with cause letter has to be viewed in a new light.
Even if you hate the friedens like to famous posters in this forum....

Do you *seriously* believe that Hyperion had any intention of handing over the OS sources (disregarding the "small detail" that they *never had* the sources since they had failed to pay their developers), and that it all came down to some missing $250 bucks? Come on...

Are we seeing a moderation policy change here, meaning that moderators from now on will remove *any* "Url/.baiting" pointing to that particular site in the future? Maybe putting the site name and url in the curse word filter to have it erased automatically?

For years and years we have had that URL thrown into discussions on this very site, and moderators never lifted a finger to do anything about it no matter how baiting or off topic it was. Last time was only a few days ago, where "Chip" made references to that site in the "Efika now at $99" news thread.

But this thread however *is* (partly) about unpaid OS4 developers (which seems to be one of the core reasons to the locked down situation). I meant no harm by putting that link in an OS4 context, I merely wanted to make a point to certain members of this board that the MorphOS/OS4 situation has similarities in this regard, with the *hope* of them quitting to slap that URL in peoples faces as soon as they see an opportunity (no fun to sneer at other peoples mess, when you have exactly the same mess yourself at your own back yard). But if you will "ban" that URL from now on...?

What this $250.00 does is change the time line of the buyback from being complete in 2003 to not complete in 2006.

We all still have a lot to learn in life.

There was a known dispute between certain MOS developers and Genesi. AFAIK no OS4 developers have aired any discontent over their contracts with Hyperion. Hans Joerg and Thomas Frieden are standing by Hyperion during court proceedings despite apparent offers from Bill Mcewen.
