Hyperion has the source code. ACK won't be having it anytime soon. The whole things fictitous until proven otherwise.

No but it probably will be by the end of the year, which is what Helge gave as personal deadline for waiting for new Amiga Hardware. Hopefully it won't come to that. |

I was actually hoping to find out the arrangement between Ack and Amiga Inc. It was a longshot, but I have been answered before.
Sometimes being nice might get an answer.
The question is more for the intent of AI, rather than delivering a product.

I'm going to try to keep this short and sweet.
Let me ask a simple question ...
Even if ACK brought together the required hardware today, would he be allowed to sell these products with the Amiga name and Amiga logos and bundled with fully licensed copies of AmigaOS 4.0 ?
IMHO, there is no simple answer to this question.
He already faces at least two obstacles ...
First obstacle ... Who owns what? Who can legally license what? Amiga Inc. and Hyperion seem to disagree, and that appears to be one of the reasons for the court battle.
Second obstacle ... What happens if Amiga Inc. wins? What happens if Hyperion wins?
At this point in time, I don't think it matters anymore what announcements were made on any websites.

It's not only about "who" wins but also "when"
And who ever it is, (unless they settle it outside court), it will take a LONG time to win...
And before that there's a lot of "but what if..." -doubt, which will likely lead other people to delay their projects aswell. |

But it shouldn't. I already asked this at an earlier stage in some ACK thread:
Why not license whats needed from both?
If I was desperate to bring a product out to get a return on investments I've done, why would I be stopped by a juristical case I'm not involved in?
To secure myself, I would get the needed licences from both. This would double the licence percantage of the product, but I would be able to sell it! The market is so dried out, everything will sell at nearly any price (take the A1 for example). But it's not business here anymore it's about persons and egos, IMHO. |
