Another news from the morphos.net site:

2004-11-30: although bbrv claims on various web forums they're doing their best to solve the problem, what they really do is this (received on IRC yesterday)

Quote:
David, this is our last warning. We will sue you for libel in Switzerland and begin this effort with the lawyers this week if you do not take down the site. This is not an idle threat. We have no legal contractual obligation to you or any one on you list. As for Wayne, this has been completely documented and Sjoerd NEVER returned the board to Genesi. I am sure your parents will not be happy this time for sure.

Indeed, and if Buck really did say this it is a clear cut admission that Genesi do in fact have enough money to cover what the MOS guys think is owed and all his comments about not being able to pay were just a smoke screen.

This story gets more bizzare by the day. It would be quite funny if it wasn't so tragic

Quite the opposite really. It's not like Gerber hasn't been asked to remove the site several times. He chose his path, seems like Genesi now chose theirs.
I do hope they go to court and get this #### over and done with.

What would You do if You had not been payed in over a year?

Hope everything goes well for Gerber...

Normally I wouldn't say this publicly, but I hope this is going to be the last breath of Genesi!

But as all the other companies BBRV has destroyed, don't I think that the last day of Genesi is going ot be the last day of BBRV trying to destroy other peoples lives!!!

Do you know what agreements or understandings there might have been between him and Genesi? No? So how can you say who is being reasonable here and who is not? Genesi has said that they have paid for what they have received, and they have not paid for what they have not received. That makes this sound more like a pay-upon-completion type of contract than a salary due regularly throughout a year no matter what is completed. But we don't have all the information, so it's impossible to say at this point.

He doesn't seem to be helping his own cause much with his current behavior.

Personally, I'd rather the situation be resolved to everyone's satisfaction, allowing the Pegasos platform to continue as smoothly as possible. But we all have our own desires, I suppose.

I'll be happy if some day forum posters are able to keep from turning into evangelical preachers when discussing this subject.... Is there a secret competition at this web site to see who can show the most over-the-top emotion about imagined wrongdoing? What's the prize? I might like to enter....

I know I don't know their agreements, but... I am sure that all the people who has been hold for fool by BBRV (You can see some of them listed on morphos.net) know what they has agreed!

Or did You only think that BBRV was only fooling around with the money of Gerber?

He/they did wait more than one year!!!

Full of prommises... but BBRY didn't hold their prommises!!!

What do You think they should have done? Waited another year

Here (in italy... ) IF you do not get payd for a month or two people become very dangerous....... just imagine if you do not get payd for a year..

Like everyone of us they need 'their' money. Probabily they have also a family to keep

Surely we can put in discussion the fact of divulgating these events on forums and websites....

.. if it is wrong from those 'boys', it is much more wrong from a CEO of a Company.

IMHO....

ok, an answer... Yes the site did help... if this site had not been updated, would there not have been any progress in the payment (if they are going to get payed)!!!

If this website had not been updated would You still think that You could trust BBRV (ups, seems like You still trust him )

If there is such a massive progress in payments, why the site it still up?

Why you think I haven't been aware of the situation for months?

And I want to also add:
- yes, Genesi screwed the devs, and maybe others. Shame on them.
- No, I have never been mistreated by them, quite the opposite actually.
- Yes, they have done things which have been bad for everybody.
- but, they have also done a lot of good.

Sadly I think that means that MOS for the Pegasos might be abandoned, unless Genesi go back on that statement soon. Even assuming that Genesi "has no legal contractual obligation" and wins the case, the MOS developers certainly aren't under any obligation to continue developing for Genesi platforms - and might well choose not to in the aftermath of a legal challenge.

I really do feel sorry for people in the MOS/Pegasos "camp" - they deserve better than this from Genesi

Maybe the "progress" is simply BBRV realising there's a problem (and then attempting to solve it by firing lawyers at it...) - without it I'm sure this whole story would just have been swept under the carpet.

@hooligan

If I haven't been payed by a company for over a year and that any attempt to solve the issue failed, THEN YES I would have done my best to warn people and show them who that company is really made off. That include damaging their reputation even if the issue doesn't get resolved, at least I could have the satisfaction that they won't get away without damages !

@gary_c

If Gerber was the only one complaining of not being paid, then I may wonder about his honesty. BUT this is not the case which make me believe Genesi (especially BBRV) are far from innocent !

I am personnaly ready to send money to Gerber and other Devs to help them afford the best defence , and try to make sure this situation does NOT occurred again.
