Hyperion did buy the reworked 3.1 sources from Olaf Barthel atleast a month BEFORE they signed the OS4-contract, so it's quite hard to argue that OS4 was delayed because they didn't get the nasty&messy orginal sources ....... and in all that legal BS they never filled a single document even suggesting that they had asked for them ....


Bout H&P not handing over that kernel (if it even existed), though luck !! Thats something that should have been checked BEFORE signing anything (just like the status of Eyetech's HW). Can't really blame anybody else for failling even the most basic buisness rules.

I'm not sure where you are getting the 13 years from... the link you provided is from January of 2003... 7 years ago.

If you go to there "About" page is where I was getting my original time. The compnay formed in 2002 or around 7 and 1/2 years ago.

No doubt they do and they must be a damned sight better at it. I never realised they made beer in Australia, just Fosters and XXXX.

Actually you do have Coopers real ale which is quite decent but much harder to find than the international cr*p.

The fact is that there was an explicit undertaking that the 3.1 source-code would be delivered together with the 3.5 and 3.9 source-code.

It was not. This caused major delays and in fact, several features of 3.9 were missing from the initial 4.0 for that very reason.

Hyperion is s*it because 2002 this, 2004 that...
For whatever reason Hyperion delayed what's been delayed (reasons that probably you have no idea about), today we are in a different situation and whether you like it or not, those times are gone.
They did good last year when the settlement was still up in the air, they will do much better this year with the settlement in place.
You might as well start living with it (just a suggestion for your health ).

As an aficionado close to inside info from parties that may not be reveled for
secretive reasons, I can say that this minuscule ATX complete computer system
was originally designed as a watchdog system to make sure the light inside
the refrigerator goes off when the door is closed. Soon we can all breath easy.

Is it not possible that XMOS are the Nemo designers?
Perhaps they wanted to commission a custom mobo that will serve as a hobbyist dream?

This in discussion with TrevorDick led to the realisation that they could kill two birds with one stone and also create a new AmigaOne?
With the result of attracting a whole new community of HW junkies to the XCORE fold?

The acid test will be if XMOS start to port their dev tools to PPC architecture or even better OS4
