| My attempt to form a constructive debate on this subject
Hyperion is major power in Amigaland and how would it being gone for good affect ACube/Aeon/Amiga Inc. and what would the outcome be ?
Just to be clear , I don't expect this to happen so I thought this could be "what if" type of subject so everyone can offer opinion.

One obvious question that would rise would be who would own the rights to AOS4 if anyone then.
Would they revert back to Ainc perhaps?
Which would be sort of funny since Hyperion put a clause to their contract with Ainc. where it said that if Ainc. was to bankrupt, Hyperion would get the rights to AOS4, and they actually used this clause in the court case which in the end was settled and Hyperion got the AOS4, but I wonder if Ainc had a clause in the settlement which would bring the rights back to them if hyperion disappears, or is it perhaps that Hyperions has lifetime license for AOS4 or something, in which case AOS4 would again go back to Aincs control. Or would AOS4 perhaps become not owned by anyone? |

Definitely a question worth pondering. Like @Bugala mentioned, there's most likely a clause that would revert AmigaOS 4.x to Amiga Inc. if Hyperion were to halt operating as a registered company.
I wouldn't expect Amiga Inc. to be reasonable on the licensing fee for someone else to pick it up so it would be a huge financial burden for the remaining players.
Upcoming A-Eon hardware will be able to be sold with Morphos on it. They plan to make most of their software acquisitions multi-platform as it is.
All in all, the existing AmigaOS 4.x users would not get any further "official" updates, and I doubt there are enough talented and committed developers to reverse engineer AmigaOS 4 to continue to develop on it.
The AmigaOS 4.x fan boys will be the most affected. I imagine they would feel the same way I felt when Gateway bailed on Amiga. _________________ All the way, with 68k |

I think that cursed A.Inc would get it back (just name AmigaOS that is and AmigaOne maybe).
Since AEon produced AmigaOnes it doesn't mean it would automaticly loose trademark but Australia and NZ are also those countries that have specific laws different from Civil Codex so I'm speculating.
One way out would be to use Aros (with permission and respect *cough*) source codes and do quick port to x64 (maybe just targeting one system and making it a little custom like MacOSX these days) so that AmigaOne hardware can be bought both on x64 and PPC platforms.

It's unlikely to happen. Hyperion would more likely be sold to A-EON or a consortium of various Amiga companies rather than disappear.

In short: Even if it all seems clear, a case of Hype vanishing would result in years long legal clusterf##k which again will with certainty result in the barely controlled egos of the people involved going on an even longer trip.

The original question asked by @bliz1220 is about a hypothetical case in which Hyperion would disappear. As in rapidly removed from the scene before anyone could do anything about it.
I agree it is more likely that some "hail Mary" tactic would be employed before such a thing occurred, but the inquisitor is setting up a particular IF - THEN scenario.
Imagine I asked people: What if you found an old oil lamp and a genie popped out when you rubbed it, and he was prepared to grant you three wishes.
Your contribution to the thread would be like: There's no such thing as genies and the only thing that happens when you rub an old oil lamp is you remove some of the oxide and grime from the surface. Read some physics books. I can't be bothered to keep pointing out the important parts.
Whilst I partially agree with @Kronos in that the future of AmigaOS 4.x is precarious at best, there are however opportunities for Hyperion to assure the survival of AmigaOS 4.x beyond their ability to maintain a sustainable business.

In all fairness I never thought Hyperion had a sustainable business from OS4 - they've only managed to keep their costs low. It is a well-known fact that the Frieden brothers are both androids (see the remarkable similarity in their design), so Ben Hermans didn't have to pay them at all. The rest of the development is taken care of by freelance programmers who work for peanuts (with the exception of Steven Solie, who has allegedly opted to be paid in peanut butter). So it's been pretty much a low-cost project all along. No business to maintain, no business to lose._________________ The Rear Window blog

Joking aside, isn't (much of that) the problem, ergo OS4 ends up with an unmaintained filesystem (JXFS), various components that 'can't be' upgraded (object-licensed from 3rd party developers to rob from/protect against AInc's ownership), and a current bounty to accumulate various hacks/partial fixes from various peoples' abortive efforts to upgrade MPlayer, into something which 'kinda mostly works'? _________________ Troll - n., A disenfranchised former potential customer who remains interested enough to stay informed and express critical opinions. opp., the vast majority who voted silently with their feet. |

| No matter who is responsible for AmigaOS4 they do a very good job make it look like crap.
They should at least have fully support the CPU it runs on like the one in the AmigaOneX1000. otherwise they should not have touched the HW in my opinion.
