Well, you could contact both parties for statement, but it is far easier to use only edited recording for your story...

Nothing relevant. They did supply some missing documentation (which, unsurprisingly, made them look even more stupid) - but I'll include that with the (long) upcoming update about the trademark wars and the legal battle. They were still not listed in the company register last time I checked.

That would depend on what the story is.
I have to side with cgutjahr here.

His reporting is not about theft, his report is about a video that popped up on Youtube, that appears to support a, as cgutjahr says, a rumour.

If anything, he should have asked for a statement from Generation Amiga.

Some stuff is hard to make out. After the beeps it doesn't even seems to be from the same continuous conversation on the same subject. As if it was just patched together from various recordings. Only because at the beginning there is a reference to Ben and Hyperion the listener may assume that the whole recording refers to that individual or entity.

We should indeed keep in mind that the recording is edited, it could very well be edited for dramatic effect, or to make one party look more stupid/evil than they are.

But IMHO the three parts that were joined to create this recording are all from the same conversation. The volume of Trevor's voice, the volume and type of background noise - they're consistent throughout the recording. And he's clearly referring to Ben/Hyperion in all three parts ("law firm", "no royalties").

AmigaNews.de is the best Amiga-related news source. I must apply much higher standards here than in case of some weird tabloid blog.

If he contacted both accused parties (the story accuses both Ben and Trevor of criminal behaviour!), waited one day for reaction and then posted simple clarification: "There was no reply from BH or TD at our questions concerning this recording", that would be solid journalism. Simply reposting GenerationAmiga "info" certainly isn´t.

you miss the point...

If that information is correct (we cannot check that)... assuming yes

then Hyperion got money and granted exclusive rights to sell a certain version of amigaos for 10 years. At that times there were only few potential buyers.

Then suddenly this version became interesting in a commercial sense because of emulation and because of that they simply ignored the contract, otherwise they would have needed to do some sort of agreement and of course that would have lowered potential profit. I see the motivation but it still does not make it honest...

TEN YEARS?????? If AmigaKit expected there will be no other AmigaOS release in ten years, well - what to say - then their assumption was not based on any sound premise.

there is amigaos versions for different PPC hardware

one version was that for "classic"

Why is it not possible to give away a license to sell the version for "classic" for a given time?

If they update all versions including the classic one they could have talked to the partner about that. That is how I would expect to be treated if I work together with someone... obviously that did not happen

Or give a license until next version but without the ten years

I recommend searching for the term "as the New York Times reports" on the internet. You might be surprised to find out that it is not common practice even for paid journalists to contact all subjects of a story that originated somewhere else.

Amiga-news.de is in fact the best news source as they at least make an effort to source and prepare articles rather than just publish de-facto advertisements and statements submitted by third parties. Moreover, it is entirely free of cost and run by volunteers, not paid journalists.

Criticizing that said volunteers may not uphold the same high standards that even career journalists often fail to meet and demanding they spend even more of their free time before they dare publish an article is, frankly, rather entitled.

Our exclusive ten year contract was for 4.1 Classic - it did not explicitly specify sub-releases such as Update 1, 2 or indeed Update 8 (renamed to Final Edition). It is quite feasible for 4.1 shelf life to span a long duration. After all it is now 2018 and 4.1 is still the release designation, some seven years after the contract date.

On other matters regarding A-EON Technology Ltd: for the record, since 2012, A-EON Technology Ltd has pre-paid significant cost of software licences in batches to Hyperion Entertainment CVBA for the X1000, X5000 and A1222 (yes it includes beta test machines). Additionally A-EON Technology Ltd has pre-paid Hyperion Entertainment CVBA significant amounts for Kernel development work and ancillary work.

I am afraid you are completely missing the point.

The discussed companies were business partners. One party contracted the other to deliver a piece of software and they financed this work. In return, they received an exclusive license that would allow them to sell the delivered software in order to gain back their initial investment.

It is not at all unreasonable for this party to assume that they would at the very least receive an advance notice from their business partner of any new developments that might severely restrict their future ability to refinance past contract work and that obviously affects an active licensing agreement.

Why is it that your standards for volunteer news reporters vastly exceed your expectations regarding the behavior of and common courtesy among business partners?
