Thank you as always for your honest and detailed reply.

I hope that those who had questions about this will take the time to read , understand, and accept.

I also wish to express my sympathy for the position the team has been put in when repeatedly asked questions about releases, licensing, policy, etc.
Developers should allowed to be developers and not have to get dragged into the politics of Amiga.

Bottom line, years of work. Of course you wanted to see the time judged as well spent.
People want product. It's obvious that the majority of the discussion on all sites and irc reflect that, more than they reflect questions about legalities. Hold onto that thought.

That is rather impossible, developers are people too. Writing code is a form of expression, and how code is written is tied to politics.

Wow, Cloanto really screwed things up this time when they sued Hyperion.
Talk about opening a can of worms. Parties long gone suddenly are brought back to life.

How long did the old litigation last when the parties finally reached the Settlement Agreement?

If Cloanto wouldn't have sued Hyperion, we wouldn't be in this mess.
Talking from a classic AmigaOS 3.1 enthusiast point of view, the withdrawal of
digital sales after just one month is really saddening. How long will the physical sales last?

AmigaOS 3.1.4 is a great product, and I would like to see future development, now that it has started.

On the other hand, It's clear that the open source route has not been a possible way forward.

I guess they opened the can of worm when they re-registered (or at least tried to) the Amiga trademark in the US. That ignited the most unexpected and astonishing escalation of fights and legal battles this platform has seen since years.

I personally consider this suing action against Hyperion's AmigaOS 3.1.4 the most respectable reaction to Hyperion registering "Amiga Forever" trademark. Probably Hyperion thought it would have been a smart move to put something on the business table, but it actually set Cloanto up for vengeance.

I am incredibly amazed by all this. Little companies litigating for the domain over a niche market, which is evidently too small to ensure earnings for everyone involved, who are also fighting over lesser and lesser vaulable IPs they were (at least in public) peacefully sharing until some months ago. This all seems a foolish remake of the famous 80s Highlander movie. Only one will last in the end: the one who won't have wasted all his money into attorneys.

If Hyperion could stick to what was agreed on, and not insist on stepping on every toe they see, they wouldn't be in this mess.

Not for long, I'm sure - it may even be doubtful that "physical sales" will even start.
I am also an enthusiast, and Hyperion is and has always been a disaster for the community-

It is riddled with bugs, and there are plenty of compatibility issues. The development model used is as outdated as the OS itself, and Hyperion require signing of NDAs by anyone involved.

(I do find it somewhat amusing when I see _who_ have signed NDAs though, several are people who earlier have been involved in more or less illegal distribution of copyrighted material, including OS components)

Just because ThoR says so, doesn't mean that it is not a possible way forward. The various OS components already have different ownerships and licenses, and this could be extended further, there is no rule or law that says the whole operating system must remain as one codebase under one license, sold as one. So one could open source the parts that legally can be open sourced, and keep closed source the parts that legally cannot be open sourced. This is also how certain other operating systems do this (Windows and macOS, to name two).

"But ah, yes... Amiga OS is so... different.. so delicate... meh"

And btw - as an enthusiast who support Hyperion on every turn - what do you think of the software license agreement that Hyperion pushes on you? Do you accept all the terms before installing OS 3.1.4 on your system?
