| some interesting news, is that Cloanto have recently secured Amiga Inc trademarks in the US, looks like this is pretty much the end of Amiga Inc, and now Cloanto seem to be the main company you need to go to get Amiga trademarks, although if I recall correctly Gateway now Acer may still hold some rights to the name as well, but cant remember now.

It is important to note that this is only the US trademark. The one in the EU is still valid for another year. And I imagine there might be more contenders for that one, now that everybody had an advance warning
Gateway mostly retained the patents (which have expired since then). Whatever naming rights they still had where transferred to AInc in 2006. |

| Who cares, the Amiga name as trademark has little value anyway and people noadays are smart enough to find out what is what (I think...:))

It has a little value for people who followed the 'Amiga scene' for years, others and a lot of mainstream media will go nuts if a company announces an Amiga smart phone with Android or an Amiga-PC with Windows10.

You might consider renaming the thread "Amiga Inc. Loses U.S. Trademarks", because it reads to me that they acquired a trademark for "Amiga Inc.", which would have less than zero value by a ton.

As for value, I think the Amiga brand is still worth something as others has pointed out, it amazed me how quick my friends let me know about a commodore phone coming out, when I looked into it took me 2 seconds to work out it was a cheap phone with quick branding on it to make it stand out, and it works, maybe not to us, but to some works.
Also just look at the recent success of certain kickstarter with Amiga branding, the books, films, A1200 case, each have made £10,000+ if not more and I think most have had to seek permission of even maybe licensed the Amiga brand to there products, who knows if Clonato will start to seek a fee for license. (
Dont get me wrong, where the Amiga trademark has been for the last few year I'm glad its with a company that is still active in the Amiga market (all be it in emulation) and have a proven track record of being usually pretty fair. (was surprise they sponsored and supported the Kickstarter Rom Replacement effort as that is a big part of there business selling legal roms)
I just kinda wish in a idealistic world, copyright and trademarks went away in the Amiga world as a lot of good effort have been hurt or effected by these issues, then again we would have 5 system all trying to call them self AmigaOS.....actually no nothing would change ) Last edited by amigang on 17-Apr-2017 at 06:27 PM.

heh. I trust you realize I was only commenting about attaching that nasty "Inc." to "Amiga" there. That would be one trademark no one in their right mind would want if it existed as a trademark.

And even the updated title implies that the trademark was ceded. By all accounts they simply let it expire.
That's the puzzling point... Amiga Inc. could have sold or transferred ownership of the trademark. |

The thing to remember is that Darren B. Cohen has 1405 trademarks to manage. I would assume that coupled with trying to close the Kouri estate (busy busy since last autumn), that this one might have slipped through the cracks.
That being said, since they did license the A1200 cases and Philippe (the cases) has announced new product(s) (unnamed as of yet), I'm not certain of the outcome either.

Irrespective of how busy someone is, I seriously doubt that this was simply overlooked.
There is also a grace period after the trademark expires and opportunity to contest a new registrant.
Cloanto will be hopefully confirm the situation but it's unlikely that they just kept a watch on the expiry and grabbed it. They have a relationship with Amiga Inc. so one would think that they would have asked to acquire the mark.

Amazing... imagine a situation now where a brand new type Amiga in a wedge case were released, A1400, containing a new mother board that featured Vampire/Natami type hardware and SAGA/AAA capabilities with all the modern outputs, midi, HDMI etc etc...
It would be like a new beginning...

If you haven't heard that is exactly one of the projects being worked on by the Apollo/Vampire team. A stand-alone board is currently in testing/prototype mode slated for release some time later this year. No firm info on specs, pricing or availability at this point. Just need to be patient.

This mostly depends on Amiga Inc status of operation. I wouldn't be surprised if they just hadn't even the money needed to renew their trademarks anymore. And I don't believe the parties have always been in good relationship, if I remember correctly they already went to court to fight for the 'Workbench' one some years ago, so the clock theory isn't too far from being realistic. In any case, this move should help placing the Amiga trademark into secure hands, and this is a good news IMHO. |

what he asked for was something like that under the brand "Amiga". But I personal doubt that this will happen because there are too many parties who think they are the only true successors. It would be best if the brand would be controlled and licensed by a independent identity who would care that every relevant company/group who produces really amiga-related products could use the name. But that is just dreaming... |

At this point I would suggest giving up on any "Amiga" branded hardware.
IMO this is like asking for an "IBM" branded PC. No point - lots of compatible hardware out there.
Whether it is "Amiga One" products, "Vampire" products or whatever Jens has up his sleeve these will all be evolutionary products of one type or another. |
