I don't have the stomach for trying to sift through dozens of legal documents to try to figure out what is going on with the lawsuit(s), so I'm really grateful that someone like you has the interest to keep people like me updated. I would ask that you give a very short summary of each linked document, in case the discussion in this thread does not clearly explain what is being linked. That way I can remain lazy and not try to figure it out for myself, but still be informed about what is going on. I trust your interpretation to be unbiased, even though I know you have a preference on how things turn out.

As much as I wish all the lawsuits were over and done with, I'm willing to wait as long as it takes, if that wait means we can finally get rid of Ben and his "lawyer ways". The guy is really, IMO, a scumbag who poisons everything he touches.

Not to spoil the Google Streetview fun, but did you notice the date of the picture? It's from 2017. I'm not in the know of whether or not the address is real - but a lot can have changed on the directory since 2017

Btw. the directory linked is a shop floor plan of the shopping center. Number 34 seemingly has an entrance just outside and mailboxes next to it.

True but please examine the CBE link. Assuming information in CBE is accurate this building has been the address of Hyperion since 2015.

Though putting aside building directories and addresses all with Hyperion is just BS anyway no matter where the mailbox is located. Could be a rat nest in a subway station.

Even if they did operate from a farm, it won’t make any difference, most developers can work from home, they don’t need an office in the middle of city where rental price is high.

But they’re not developers are they? They’re lawyers/publishers rather than developers. Their ‘developers’ are expected to work for free from home for sure!

Well with online store you don’t need to be located in main street of city to sell what you publish. And when you sell the software, do actually burn dvd’s/cd’s etc or do you pay for a service. I do not think acutely make the box, or print the small A3 paper that comes in box. They might be package it, but that’s maybe all they do.

The OS 3.1.4 floppy labels were "home printed", I recall.

(They were also falsly printed with "All rights reserved" instead of "Developed under license", an error that mysteriously had its origin in Olsen making a small mistake in the OS source repo... and noone noticed until way after product was shipped - sounds incredible, probably is)

I am not avoiding responding to you Dave. Being on the verge of a new court filing, I was merely waiting for said filing to appear. imo they are cutting it close this time, since attorneys need to know new due dates for the stages of a trial ahead of time.

There is some indication of "change", but currently unclear as to detail. Mind you, some folks trust this source, others do not...so take with a grain of salt for the moment:

Did Hyperion ever try to buy the rights to Amiga name from trademark holders? During the legal actions with Amiga Inc / KMOS / etc. did they offer too high price? The legal actions over years most costed fortune. Was there ever any offer from Amiga Inc / KMOS / etc to sell it?

I think mostly this about willingness to solve the problems with different companies involved in this, my impression that neither party wonted to backdown.

Amiga Inc selling the right to Cloanto at same time as signing the settlement agreement with Hyperion, was pretty devious.

Contractors selling ExecSG to Trever, and selling Roadshow independent from AmigaOS, make lot of sense to fund development, if Hyperion can’t pay for the work. if Hyperion is not paying for the work, they can't really came to own it, anyway if Hyperion goes bankrupt, the creditors can file a claim, that includes any contractor who has done worked for Hyperion, they can get compensation from the bankruptcy trustee, after Hyperion has gone bankrupt.

In short Cloanto, will be forced to compensate the developers if they obtain the right to work, that was unpaid.

Yes

It has to be seen what will happen then with 3.1.4 and OS4

It seems (from outside) as a legal mess (not untypical for amiga world)

It could be the end of both

I do not believe that Cloanto will pay bills caused by Hyperion just to save 3.1.4 or 4.X. Then both products will cease

Perhaps Trevor D. could pay the bills if he gets access expecially to 4.X. For him it would make sense...

That would mean Kjetil thinks rights went to Cloanto when the settlement agreement was finalized with Hyperion in 2009.

erm...

The first mention I see by Cloanto of any acquisition was 2012.

And the Pluritas deal I mentioned above was for other assets as noted in the docs and also later than the 2009 settlement.

Given it's Ben whos doing the blaming it might be that devs are licensing, not donating their work to Hyperion. Because it's pretty well known that Hyperion owns F all.

There is only the "1" active case atm.

The earliest case was terminated when proceedings were moved to Washington State USA.
The 3rd case was "suspended" pending outcome of the active case.

settlement means you have already a legal dispute so it would be about components used already in products
