@cgutjahr

"This is much more likely an issue between A-EON and Hyperion and/or A-EON and Amigakit."

As a purely factual statement, I can state that your conclusion is entirely wrong.

Please check your sources.

I seem to recall journalist are required to double check sources/the parties involved and not put forward pure speculations.

Best regards,

Ben Hermans

(Whilst this is a purely factual statement, I will still add the usual disclaimer that this reflects my personal "opinion").

A-EON has licensed the "AmigaOne" mark from Hyperion, which in turn has a license to use and sublicense the mark thanks to the 2009 settlement agreement with Amiga Inc. Battilana is trying to have the settlement agreement declared null and void in the court battle, but as of now it is still active.

It's questionable that Hyperion ever owned the Amiga trademark to begin with, so any license agreement between A-Eon and Hyperion over the brand "Amiga" is likely null and void. Retailers don't remove trademarked names from their web sites based on whims or rumors and only rarely will they do so based on the expectation of a court decision. They were told to take it down and something has already occurred, we just don't know all the details as yet.

We do know that Hyperion is bankrupt, under the control of an attorney who was recently fired from his partnership with a respected firm, and that funds set aside by A-Eon were used inappropriately by Hyperion....At the very least you have retailers who are trying to distance themselves from Hyperion in order to minimize any potential collateral legal and financial damage that could be directed at them.

Looks like the Court under the testimony of an expert on the 2009 Agreement has decided that Hyperion had license to use certain Amiga trademarks, like AmigaOne, but that did not extent the right to sublicense those trademarks

@HyperionHolding

Here's another fact - your website is broken and doesn't work over https, and the certificate expired more than two months ago - yet you require customers to register and log in to get "support" and "free updates" for products they have bought. What does GDPR say about protecting customers' privacy? What fines does the EU suggest for those refusing to adhere to GDPR?

I expect nothing but utter silence on these questions, and I expect nothing to get fixed, because all actions indicate that you simply do not care - you don't care about your company nor do you care about your customers. What you clearly care about is "the trophy" and pretending that you own something and through this pretended ownership, can exercise some sort of power. It's utterly ridiculous.

Please do not link to Generation Amiga - it's not a nice thing to do. But even their article doesn't say what you just claimed it says - the key phrases are "quoting an expert" and "(expert thinks) it could violate...".

The court hasn't decided anything. That an expert paid by Battilana comes to the conclusion that Hyperion is evil is not much of a surprise and shouldn't be used as a basis for any claims about what's going to happen in the future (even if I personally think his conclusion is valid).

Expert witness talk is more appropriate for the tm thread anyway, and the news is almost a month old:

Why would that be? Things like posting about "AmigaOS 4.1 for Mac PowerPC computers" that turn out to be little more than click bait? Well, the article was only short, so I was only annoyed for a short while, to find I wasn't reading about OS4.1 running on a Mac but some guy who bought a Mac G5 to run OS4.1 on and faled. Is this some guy thing not reading the instructions and hoping to figuire it out? The misleading loses credibility to me but the site graphics always looks nice.

Ok, Im tired of beeing lied too like many others,bring forth the guillotine/the crackers!

Hack the shit outta this...
Promise you there's some other direction of concerns then from the officials!

It shure doesn't look good on the official front....

Cheers!

3..2..1.. Crinche..

EDIT WHILE WRITING:

Fuck it, someone got to be the instigator!

CLASS ACTION LAWSUIT AGAINST THEM AND THEIR LAW!

I think it's time for the Amiga community to join forces..

YES there's a lot to complain about.
All the promises..Think about it for a second!

WE are the Amiga community, lets burn it down and start over fresh,
IF half of the active Amiga users join the cause we are in a good start for
a class action lawsuit!

Why?
Because we are a bunch of "fools" worth selling wares to in the first place!
But we have a voice and it have been silent for too long.

P.M me with hate or love but try to be constructive either way!
You will get a new e-mail adress for further discussion of site!

I believe it is 3..1..4..1.. but I have no idea what "crinche" means.

As for class-action style lawsuit... that can happen, regarding the Hyperion software licenses which come with ridiculous demands, and also regarding the distribution of "free updates" through a very insecure web site, running ancient outdated and unsupported web server stack, that puts all users at risk for phishing as well as extraction of what can be considered personal information. And no GDPR compliance whatsoever.

@thread

To be clear, my posts through #17 first page of thread only refer to the initial topic of the thread.

However, there is more interesting information that might clear up a few other questions.
We're talking court documents again, so I have no problem with them.
Feel free to discount them if you like. It's your right in this discussion forum.

Read...decide for yourself, but this addresses at the very -least- 2 questions I've seen.

Who paid the 1/2 million to revive the Amiga corporate status back to "good standing"?
initial source on that topic

What is Amiga Inc.'s stance on the inclusion of emulation with OS4.x?

We should all ignore Cloanto that is what we should do. This nonsense has gone on for too long, first with Amiga Inc and Hagge and Partner and then with Amiga Inc and Hyperion, and now Clanto and Hyperion.

I've got nothing against Cloanto. I bought Amiga Forever in 2008 and thought it was good purchase.

I've got nothing against A-EON either, but their systems are too expensive, so I haven't purchased one.

I've got nothing to say about Hyperion. I haven't purchased anything from them, and I'm not planning to.
