Proper companies have a clear "road map" label with risk disclaimers for their in-progress R&D promises.

What's being sold only has actual deliverable hardware features.

Clear communication is not a strong point with Let's "Keep this party going". So much for being a lawyer.

Dear Refferals,

I wish to make a claim in direct undelivered product
AmigaOS 4.2 against AmigaKit as part of purchased
AmigaOne x1000 purchase. Machine was delivered
with betaOS with promise of final version prepaid,
which was clearly indicated and accepted by customer.

But product was never delivered.

Proof of purchase can be obtained from both parties,
while AmigaKit

Beside named fee (about 80GBP) damages caused by undelivery were purchases of additional software
AmigaOS 4.1 FE
AEON Enhancer
x1000 Radeon Driver
AEON linux for x1000

All in range up to 200 GBP

Also I had to buy
Wi Fi card
LAN card
Southern Island gfx card

All in range of 200 GBP

This is indeed small claim but its important to have IT salers and suppliers from UK being responsible.

Delay was never communicated by AEON and AmigaKit

When after about 1.5 years customer complained on unusubality with beta software and wished to return whole machine, he was denied by some strange 1 year base guarantee for whole machine, which should be 2 years by EU laws of time.

Your “First Contact” AmigaONE X1000 system is supplied with AmigaOS 4.1 Update 5 and a license for AmigaOS 4.2 which can be downloaded from the Hyperion Entertainment website when it is released.

As of until 2024 AEON and AmigaKit, exclusive x1000 distributor havent contact me on it.

Instead they sold me about 200e hw and 200e software that was to partialy mitigate what full final OS 4.2 would do (OS 4.1 beta 5 did not support much of x1000 hardware)

The offer of 4.2 was made by Hyperion Entertainment who were partners of the original A-EON Technology CVBA company. You should contact them and ask where OS 4.2 is ?

A-EON Technology Ltd produced the later X5000, A1222+ and are nothing to do with Hyperion or the CVBA company. Due to the problems and delays with OS4 development, A-EON Technology Ltd was forced to create the Enhancer Software to be able to release the X5000/A1222+.

Clear now? Topic needs some IT knowledge, imagine having Windows XP with no drivers for half hardware on PC, forcing you to buy un needed hw that is supported, new software and that Windows 7 that would support fully your hardware was never given to you. You would sue
company that charged you, its on them to go down the lane and refund cost.

I'm confused! What difference would AmigaOS 4.2 have made? What feature were you waiting for? SMP Multicore? Who cares this many years on? I'm sure you were after a technological curiosity rather than a fully functional computer or you'd have bought a computer that didn't have an EOL CPU, had an office suite and also a modern browser?! Everyone knew what these systems were i.e. a risk like the Eyeyech machines were (more so in the case of Eyetech / MAI Logic hardware)! Also, why have you waited over 10 years to complain?!

Do what Trevor did; lick your wounds and buy the next Amiga NG pipedream or bail and buy something else! Simples!

Trevor can lick his 2000 eur wounds how much he wants.

OS 4.2 should have drivers for Nemo incl sound, network, full Warp3D and OpenGL
and yes, dual core, while being 32 bit. In nutshell, OS that supports the board.

As you know, not having it costed at least 200 GBP more in sw and 200 in hw
and this is low estimate with no postage, no import fees.

Browser and Libre are separate lie.

If they did refund it all when I wanted to return it, I would certainly move on, but they had some wicked 1 year base guarantee, no returns against EU laws.

AmigaKit and Trevor AEON are so sound bussiness they havent responded when emailed on this at all. Serbian politricks stylee

Thank you for contacting me.

Although I can mediate these cases and am familiar with technology dispute cases I do not recommend you use a private mediator for a small claim as the fee would be disproportionate. In addition mediation is consensual and I can see no evidence that the target defendant has agreed to mediate.

Assuming that is the case I suggest without seeking to give you advice that you write a letter of claim and if you have no response issue a claim in the small claims court. There is then a court based mediation scheme that is free of charge apart of course for the court fee which you will already by then have paid.

A-EON Technology Ltd. will claim they’re an entirely different company than A-EON Technology CVBA, but it’s all just smoke and mirrors - when AmigaKit bought into the A-EON brand, they also bought the baggage and garbage that comes with it.

I do have iMac G5 since I retired x1000 in 2018 (and later sold in 2023)

Seems time works for me,

On both direct summ (OS 4.2) and damages UK court says you have right
to interest in your claim

I now claim approx 460 GBP which is 35 GBP per year - about 350 for 10 years, about 380 by now. So I might get a fat court refund.

If you were owed ÂŁ1,000:

the annual interest would be ÂŁ80 (1000 x 0.08 = 80)

you’d divide £80 by 365 to get the daily interest: about 22p a day (80 / 365 = 0.22)

after 50 days this would be ÂŁ11 (50 x 0.22 = 11)

The product worked and had less hardware bugs than the previous Mai Logic AmigaOne hardware! The drivers and software development was slow and some on board features were never supported but work arounds and supported cards were forthcoming! This IMHO was as successful an AmigaNG launch as there has ever been. The X5000/40 by comparison had no fanfare and 3 cores idling compared to just one on the X1000! The hardware is hence even more underserving of the X5000 hardware!

Your expectations were too high! It was a risky purchase to "Keep the Party Going!"

You owned one of the few PA-6T CPUs not destined for military spec hardware! What a claim to fame!

And you havent really used it? x5000 corrects most of these plus adds MorphOS
but Trevor didnt send us replacement boards, which would be decent thing to do,
since we sponsored its development.

Again, Baron, STFU if you havent really used CFE.

Let me get this right; you EXPECTED Trevor to send you a X5000 mobo to replace your X1000 one (now sold) free of charge because of the boot loader? I get that it's annoying that CFE can't be upgraded but hell, if everyone got a refund or replacement product after the firmware updates finished there'd be no one left in business! Is the X5000 what you thought the X1000 was, is that the problem?

It can read amigaboot from USB but if you intend to boot OS4 off USB that won't work. There were some changes to support ISO9660 over USB in amigaboot. But I couldn't get it to work. I tried FFS, SFS and ISSO9660 formatted USB. All same result. If amigaboot can load it cannot find USB device even after loading from USB device.

I found there is a beta LAN driver. But was too unstable for any release. What I don't understand is how Linux has had a working driver for years but this cannot help to assist the O$ driver.

I had a souped up HD4890 that wasn't put to best use in my X1000. Was noisy and took 20 seconds to boot on the monitor until CFE kicked in. But I know that a 5450 or similar and above would break as there would be no driver back then. What card did you have?
