The contract says:
"Amiga hereby grants the AmigaOne partners a right and license to use and modify the Software and an exclusive right and license to market and distribute OS 4 as a standalone version for the Target Hardware and as an OEM version shipped with the AmigaOne."
The definition of "Target Hardware":
"the PPC based hardware developed and marketed for the Amiga platform including but not limited to the hardware developed and marketed by Phase 5, DCE and the AmigaOne hardware developed by Escena under the contract with the AmigaOne partners"
This basically means they have a license to market and distribute OS4 to any PPC hardware which is "marketed for the Amiga platform", including but not limited to the existing Phase5/DCE/AmigaOne hardware. Now IANAL, but "marketed for the Amiga platform" is a pretty broad term, it does not say that it must be an addon card for the old 68k-based classic Amiga hardware, it also does not say that the hardware must have a license from Amiga Inc. The hardware manufacturer should only need a license from Amiga Inc. if they want to use the Amiga name and logos for their board. For example if Elbox says they finally want to release the SharkPPC (not saying this will happen, it's just an example) then there's nothing stopping Hyperion from releasing OS4 for the SharkPPC. Also if Elbox says they're releasing a standalone version of the SharkPPC that is not an addon card for a classic Amiga hardware, the situation should be no different, as long as they make it clear that this board is developed and marketed for the Amiga platform.
However releasing OS4 to the Playstation 3 or Mac Mini would be a problem, as those are obviously not developed/marketed for the Amiga platform. Last edited by COBRA on 15-Jun-2007 at 03:30 PM.
