Well it will be very simple to prove one way or the other...

Just have Leo send an official Cease & Desist notice to TheDaddy on behalf of CUSA and I'll happily pay for my Solicitor to have it all checked out...

Seriously, start a thread about the case and keep it on topic.

If people want to have a "legal" thread. Make a separate topic and put it in either "free for all" or "Amiga Inc. offshoots". How hard is that?

I think I've read here somewhere that if you do not make active use of a trademark that at a certain point it expires. (May I've got everything wrong ). But at least this would explain why BMcE did this strange deal with iContain and also keeps the horrible website alive ... just to demonstrate that he is doing business with the Amiga trademark. Just an opinion.

I was kinda hoping that no one would have made that public on the forums as I've been waiting since last September for "someone" to try and officially issue a Cease & Desist or warning not to use the Amiga trademark which became "dead" on the 19th of September 2011...

Oh well, the cats out of the bag now but I'm surprised Barry didn't want to pay the fees to re-register it as he knew the Trademark was dead as I had mentioned it to him)...

So now that everyone knows it's dead then I don't suppose you'll be receiving any legal correspondence from CUSA now {even they wouldn't be daft enough to try that, would they !!!)...

Been thinking about registering it myself since last year and basically licensing it for a fee of penny to people in the community to use for their projects (that way it would end all this BS by CUSA), perhaps it's time I did so as Barry obviously has no intentions of paying the fee...

I need to decide if it's worth the fees just to finally put an end to all this BS once and for all, what do you think...

These are the two Amiga trademarks that have been available for registering since September of last year. I've been watching them in amazement that CUSA (or anyone else) never bothered to register them and been holding off doing so myself just to see if anyone actually would register either one of them...

Reckon it's time to bring the Amiga name home to the real Amiga Community and basically licence it myself for a penny to folk who genuinely are Amiga fans and not a bunch of rip of merchants...

True... but just think if the owner of the above Trademark prevented anyone from using the Amiga trademark to advertise or use on their software, be kinda awkward trying to get folk to buy a new system when you can't advertise any software for it using the Amiga name...

Yes but in this case we're talking hardware not software. Software would affect Hyperion more than CUSA.

Since currently AmigaOS and AmigaOne are not only dead they have been removed entirely.

Nonetheless there's only one active trademark and it covers:

"COMPUTERS, COMPUTER DISK DRIVES, RAM EXPANSION CARTRIDGES, COMPUTER MONITORS, AND COMPUTER MODEMS"

and NOT Computer Cases.

Like I say, imagine CUSA selling their "Amiga Hardware" and then not being allowed to use the name "Amiga" in any software that they may wish to sell or distribute for it, or anyone producing software for CUSA Amiga's not being able to use the name Amiga in their software or to advertise it...

Be a bit messy trying to explain to their customers where to find software to run on it, and a computer without software is just a pile of worthless circuits...

Don't see a long term future in selling new hardware that you can't mention where to get the software from...

AmigaOS & AmigaOne are two entirely different trademarks from Amiga and not something that concerns me...

EDIT: Just a thought... imagine having to remove the "Amiga" name from say a site like "CommodoreAmiga.org" which falls under the terms of the above trademark...

That's a huge grey area that I personally wouldn't want to get into. Nissan computer got sued by Nissan Motor Company. Nissan Computer won and was awarded damages. However what they were awarded according to them was only about 2% of the cost to defend the case.
