Hyperion has never owned the OS. Neither has Hyperion ever owned the registered Workbench trademark. Cloanto on the other hand owns it all, if they speak the truth (which I see no reason whatsoever to doubt), they even own the OS first launched with the Amiga 1000 that Timothy mentions, and AFAIK they have been selling it since 1997. I truly believe that they have all necessary documentation in order. Hyperion was kind of late in the game in that regard, and again, they have never been the owner, so...

Good points.

Thanks!

I wonder how difficult it is for A-Eon to walk this tightrope of supporting both Hyperion, who they depend on to provide an OS for their hardware, and Colanto's owner, which I believe Trevor has had a long time friendship with?

I think they should just sit back, relax, continue doing what they are doing right now, and watch how things folds. I know there has been some frustration about Hyperion coming from AeonKit, slow development and such. Maybe a cooperation with Cloanto could be a salvation, depending on how things plays out...?

Michael Battilana did recently picture Trevor as a decent guy as well (during a speech somewhere).

Good things can come out of this!

The A.L.I.C.E press release from A-Eon describes Amiga Forever (and Amikit) as the core of A.L.I.C.E, so there is a business relationship between A-Eon and Cloanto.

Trevor and Michael have been friends for a long time and it was Michael that introduced him to Ben Hermans. You might say the Michael is indirectly the reason that A-EON exists.

This is not good news. Why was the Workbench distribution withdrawn from Hyperion's website?
Let's hope it will return, and that we will see more updates to 3.1...

Why can't everyone just get along and make more Amiga magic instead?

Nope, that's Cloanto's 3.X ROM you're thinking of, which removed workbench.library to fit other modules. Hyperion's 3.1 ROM includes workbench.library and icon.library.

@Daedalus

I would like to burn a new 3.1 ROM chip with the Hyperion Kickstart, because I enjoy
the new boot screen.

Does anybody know someone or what company that can burn 3.1 ROMs?

There are a couple of companies that have released 3.1 ROMS during the years,
so there should be one who can...?

What are you guys talking about??? After reading your message, i signed into my customer-account on hyperion-entertainment.com, clicked on "Downloads" -> "AmigaOS 3", and voilá, all files are there, since 2016, without interruption! I think you are doing something wrong, haven't registered your products in the download area, or haven't registered a account at Hyperion?

If you don't trust me, have a look here:

@Kotler

When buying eproms from http://www.buyicnow.com they can burn the files for you for just $0.5 extra.
Just prepare the files and e-mail it to them.
This chip will work well for you. http://www.buyicnow.com/it.php?i=98

I don't know what machine you intend to use the kickstart with but preparing the files with for example remus is easy.

@NutsAboutAmiga

and the situation around 4.X is great with its dynamic development and steady progress?

In my view the basic components in a small platform should be open source because that is the only thing that can guarantee long term availability to developers. A small closed platform controlled by few individuals is always at merci of few

Well any progress is good progress in my book, sadly from the outside looking in, it seam a lot of developers time is taken up by support new hardware, instead of improving technology.

If you read my complaints about AmigaOS, you know that I don't think it rosy garden, I mean many of my suggestions has been shoot down, I can't force anyone to do as I say.

"you can lead a horse to water but you can make it drink"

But I'm not depended on Hyperion to do all the work for me, I can do a lot on my own.

UTF8.library is tiny contribution in that direction, this is technology, that will at least improve my programs, other AmigaOS4.1 developers are free to use if they like.

I'm also spending time on things in LiveForIt-Music that will be part of other programs I will make, I'm building my own little library of code, that can be reused. This is how I'm thinking now.

We hobby developers have been doing this for years with AmigaOS3.x lots of patches of libraries and GUI's you can download, if like improve on AmigaOS pretty basic functionality.

I can have deep impact working on MPlayer / Basilisk or other things that we Amiga users care about.

The only real limitation is time / money, and the energy and will to do so.

Another of this technology's that is really blooming I must say is Hollywood, its really great what this developers are doing, for AmigaOS/AROS/MorphOS in general, Hollywood is also commercial driven, you need to pay for their software to use it.

Well, it's not there so it was pulled. I'd say that Hyperion is not in the clear though, since they are still using the Workbench trademark. I think it's clear that Ben Hermans tactics is to combat in the gray area for as long as possible, to let as much time pass as possible, so he can somewhere down the line claim that Hyperion has been using the Workbench mark for a product [albeit not for sale on the market, but still available to customers as an update] in an upcoming legal discussion/opposition about his rights to claim the Workbench trademark in a different jurisdiction. That was most certainly the whole purpose of releasing their "Workbench 3.1" product in the first place (and why they haven't bothered with it since, other than the "update" that's still visible), to have it on public display so to be able to claim the Workbench mark at some point. Hybrid warfare in the same way as when Russia invaded Crimea. Or when Hyperion robbed OS4 from Amiga Inc for that matter.

BTW, do you know if Hyperion's "Workbench" is still for sale through some third party dealer?

No. I have not even considered that as a possibility.

I think if someone did, and supplied a direct link, there would be another take down order, don't you?

Well, well, it turns out that Hyperion has indeed continued to infringe the trademark by having Workbench available all along.

They didn't pull it at all...

Two word answer to your question is:

"Ben Hermans"

The lawyer who some saw as a savior of AmigaOS, but most realize now is far from that.

Personally, I don't think there will be a good situation for AmigaOS4 to progress at a reasonable pace and the community to be at peace without constant lawsuits, until Mr. Hermans has given up and left the Amiga scene. Others might disagree.

You do understand the laws of copyright?

If someone else owns the copyright to the name Workbench NOW, for use with computer software and OS, then it would seem Hyperion is again breaking the law. Maybe it is you who need to take your "reality" pills.

Well this is not workbench disk, it's a workbench zip, so totally different thing.

It just like my workbench I have my computer on is totally different from workbench used to cut wood.

@NutsAboutAmiga

Now I'm confused....

If any of this is true, shouldn't a lawyer have known this from the start? Why is this being given as a legal reason now?

Lawyers are not judge and jury, people fight over all kinds of stupid things, and lawyers tend to get rich.
