Amiga Inc never had access to the 3.1 source code so Hyperion got it from Olaf Barthel who had some kind of legal guardianship over it, due to money being owed to him.

This is what Bolten Peck had to say with regard to the OS4 contract.

"When I got there in 2000, Bill McEwen told us all that 'Classic is dead. There's no money there at all in that market. I didn't agree, and it turns out he was kind of wrong. Hyperion took on OS4 entirely on their own, it was their idea, and they actually had to kind of goad Amiga into letting them use the name."

Hyperion and Cloanto are in a legal battle at the moment... I do not expect anything interesting right now, certainly not before legal issues are sorted out

MorphOS team might be more interesting, they can say what they like without need to be careful what they say
