| I forgot: Everyone who bought or buys something at ares-shop get's 5% cashback in Form of amicoins. So basically those roms are are free for everyone who bought something for 20€ or above (incl. shipping). As long you use the cash back to buy them in the store.

| Have I understood right that if you want to use the latest Amikit (PPC) for AOS4.1 FE, you would need this Cyberstorm ROM to make it actually work? Similar to as Cloanto is selling legal Amiga kick ROMs which are reguired by Amiga forever? |

| You need those roms to emulate "legally" a Cyberstorm PPC board. Which is needed to run AmigaOS 4.1 classic in WinUAE.
Yep basically as Kickstart roms included in AmigaForever. While just using them may look for a end-user ok - I as comercial entitiy have to stay clean. You could be sued to easely.
I plan to sell bundles of USB-Sticks and Computers with AmigaOS4.1 and to be on the safe site i added them to the store, so the usb-stick (activation tool) can grab it from the store and Register the user.

I suggest you get in touch with Ralph to clarify the situation.

what smurf game? is this something you're offering on your indie-go appstore platform? i realize english isn't your first language, but it's terribly difficult to understand your post. could you please clarify the various allusions you've been using?

Hes comments had to do with some previous things that had happened before.
But just to explain the smurf fan game part. I guess he referred to the idea that when Hippoonios made Smurf game, was it last december, that when he released it, he got "cease and decease" - letter (or whatever they officially called) and was asked to pay peyo 2000 euros to settle the issue.
Hence, 120 x smurf fan games = 240 000 euros = 2 developers working on AROS full time full for 3 years = 40 000 EUR / a year salary, which i think is more than a fair wage for them (over 3 000 euros a month to do something they probably like doing anyway). |

| First of all, thanks, I don't have an issue with paying for the ROM's and I beleive you got the rights to them, but I was not able to find them on your appStore.
Second, if some people acts like a-holes, there is no reason to become one, just ignore them. There are plenty of people out there who are more than willing to be nice. _________________

did he release them to DCE or to the public? if the former then why would he state otherwise? and if the latter, how can you re-sell them? i'm just trying to understand why he would, all of a sudden, appear again in the amiga community to comment on this and whether or not the ROMs are in the public domain, owned by DCE and licensed to you, or now owned by you.
can you clarify the situation for us? thanks!

| I think both have rights. It is the typical "amiga-like" legal mess. If I understand Pascals intentions it is not selling roms to average user and make money of it but to offer preinstalled OS4 and for that he need the permissions by the copyright owner(s). | Too complex and I would really Need to argue against this and I don't wan't stress.
so no roms.
Those things Mr. Schmidt has shared are just updates. No roms. He still says that he and only he has the right to license them. He will not release them to the public or license at all.
DCE on the other Hand has the right to protect their products and so could only sue People for releasing a virtual copy of their own product, they again bought from Phase 5. Halleluja!
It is a bit strange and so if at all I had to start a legal Action just to get Access to the truth which could be excactly what Mr. Schmidt is telling. That Phase 5 licensed them from him and didn't own them at any Point. Nor did they get a unlimited right to redistribute them to others. A right which coulld have been moved over when DCE bought valuable content of Phase5
So I act respectful and believe Mr. Schmidt without asking further and digging deeper. The roms will not be offered again.
At least we know that it will stay technically illegal (because of 2 Independent entities) and just tolerated.
