No argument. We deduced that some time ago.

I'm merely curious if/how this might affect others in the community who think they have a license for:

Time will tell. =)

By the way, the official decision has been published on the EUIPO page. Polabe's oppositions have been rejected.

So when are they going to make something worthy of the Commodore badge instead of some cheap china manufactured mobile phone.

I could not agree, maybe they should do what former C= did: Copying Apple.

Currently Apple makes a fortune selling china manufactured mobile phones.

Not quite so official.

I hope the following more current summary (I tried to be brief and to point) brings this matter up to date:

SO many times I heard the argument concerning non-use. If you read the comment at bottom of the last link I supplied, this is directly addressed.

Nothing that may impact CBM's current registration. A belgian court ruled out that EUIPO didn't act very well when it canceled the C=Commodore brand in 2015, and should pay the expenses. According to the documentation, this saves only their registration of the trademark for specific categories of products, the only ones C=Holdings demostrated use of (videogames to be used with TVs or computer monitors). EUIPO might also appeal this decision, if they like.

If you read the whole stuff, Commodore Business Machines is never mentioned. Moreover, C=Holdings/Polabe/whatever must pay expenses for their rejected oppositions to CBM. The EUIPO, again, ruled out that they didn't properly use the trademark in the 5 years time frame.

Blah, blah, blah, didn't Individual Computing get a C= trademark license? That was quite interesting but other than that C= should just be left to rot. Atari's brand has been nurtured over the years but C= is worthless now.

They got a license for the C=Commodore trademark from C=Holdings, which is the one the EUIPO first canceled, and then re-activated for a limited range of products. By the way, that's the past and I like the guys at Individual Computers. I've bought a Keyrah from them long ago I still use on my modded A1200.

I cannot agree here. IMHO, the C= brand deserves to be used, on nowadays hardware. There's neither any practical, nor any ethical motivation to "let it rot" as you said. I'm very fond of Commodore, since it had been the computer maker which gave a precise direction to my own life. Probably it wouldn't tell anything to young people, but the C with the flag still warms my heart when I see it.

Just reminds me of the arses that both saved and screwed over the Los Gatos team. Jay, Dave Morse, Carl, RJ etc were the people I have a fondness for and not the C= company men. Jack (C= main man who everyone remembers as the soul of the company) screwed over Chuck Peddle a real computer / CPU designer genius C= seemed to try and demotivate every engineer that ever worked there. Yes they gave them freedom but they definitely didn't manage them correctly or market their products. I can't 'love' the chicken head and the memories of their corporate madness depress me. Thanks for the Commodore Amiga but screw them for everything else.

.. oh yeah the Vic-20 William Shatner adverts were a good idea too Credit where credits due

...But what about squandered product placement opportunities in Star Trek IV: The Voyage Home and later Jurassic Park? Morons...

Makes me wonder about any connection:

@Petah

I don't think a scam watch devalues the Atari brand. It is used on T-Shirts and other branded products the world over! It was used to launch one of my favourite PS3 game Ghostbusters. It is alive but the last time C= was at all used in relevant way was the Commodore Gaming PC cases over 10 years ago. The brand is dead IMHO. Commodore died long live the Amiga!

@BigD

Although the history of Atari is pretty convoluted, it does not look as if there is any confusion about or legal challenges to the ownership / brand rights.

Stores like Target and Walmart are inundated with retro inspired items - toys tshirt magazines households items etc.

But nothing with C= or Amiga

Reference post #212 this thread for prior update.

3rd time is the charm? Back for the 3rd time:

Nature of business (SIC)

26400 - Manufacture of consumer electronics

Also very interesting to note this article about who was behind the objection to the trademark:

Michael Gleissner the instigator of this cancellation action against C=Holding

also here as Commodore International Ltd.

"Infamous troll" Michael Gleissner involved in 5% of all live contested trademark cases in United Kingdom

I for one look forward to the Commodore underpants gnomes. (southpark)
